Stat. tit. 45, § 45-777","heading":"Abatement of violation - Notice - Hearing - Cessation","body":"orders.\n\nIf the Department determines that any permittee is in violation\n\nof any requirement of this act or any permit condition required by\n\nthis act, but such violation does not create an imminent danger to\n\nthe health or safety of the public, or cannot be reasonably expected\n\nto cause significant, imminent environmental harm to land, air or\n\nwater resources, the Department shall issue a notice to the\n\npermittee or his agent fixing a reasonable time not to exceed ninety\n\n(90) days for the abatement of the violation and providing\n\nopportunity for public hearing.\n\nIf, upon expiration of the period of time as originally fixed or\n\nsubsequently extended, for good cause shown and upon the written\n\nfinding of the Department, the Department finds that the violation\n\nhas not been abated, it shall immediately order a cessation of\n\nsurface coal mining and reclamation operations or the portion\n\nthereof relevant to the violation. Such cessation order shall\n\nremain in effect until the Department determines that the violation\n\nhas been abated, or until modified, vacated or terminated by the\n\nDepartment.
