Stat. tit. 45, § 45-782","heading":"Petition to designate area as unsuitable for surface coal","body":"mining operations - Hearing - Decision - Impact statement.\n\nA. Any person having an interest which is or may be adversely\n\naffected shall have the right to petition the Department to have an\n\narea designated as unsuitable for surface coal mining operations or\n\nto have such a designation terminated. Such a petition shall\n\ncontain allegations of facts with supporting evidence which would\n\ntend to establish the allegations. Within ten (10) months after\n\nreceipt of the petition the Department shall hold a public hearing\n\nin the locality of the affected area, after appropriate notice and\n\npublication of the date, time and location of such hearing. After a\n\nperson having an interest which is or may be adversely affected has\n\nfiled a petition and before the hearing, as required by this\n\nsection, any person may intervene by filing allegations of facts\n\nwith supporting evidence which would tend to establish the\n\nallegations. Within sixty (60) days after such hearing, the\n\nDepartment shall issue and furnish to the petitioner and any other\n\nparty to the hearing, a written decision regarding the petition, and\n\nthe reasons therefor. In the event that all the petitioners\n\nstipulate agreement prior to the requested hearing, and withdraw\n\ntheir request, such hearing need not be held.\n\nB.
