Stat. tit. 45, § 45-783","heading":"Limitations on surface coal mining operations","body":"After August 3, 1977, and subject to valid existing rights, no\n\nsurface coal mining operations except those which existed on August\n\n3, 1977, shall be permitted:\n\n1. Within one hundred (100) feet of the outside right-of-way\n\nline of any public road, except where mine access roads or haulage\n\nroads join such right-of-way line and except that the Department may\n\npermit such roads to be relocated or the area affected to lie within\n\none hundred (100) feet of such road, if after public notice and\n\nopportunity for public hearing in the locality a written finding is\n\nmade that the interests of the public and the landowners affected\n\nthereby will be protected;\n\n2. Within three hundred (300) feet from any occupied dwelling,\n\nunless waived by the owner thereof, nor within three hundred (300)\n\nfeet of any public building, school, church, community or\n\ninstitutional building, public park, or within one hundred (100)\n\nfeet of a cemetery;\n\n3. Within twenty-five (25) feet plus one and one-half (1 1/2)\n\ntimes the depth of the surface cut from the property line of an\n\nadjacent property owner, if the surface cut removes and does not\n\nreplace lateral support, unless there is written agreement between\n\nthe operator and the adjacent property owner; or\n\n4.
