Stat. tit. 45, § 45-901","heading":"Definitions","body":"As used in this act:\n\n1. \"Active workings\" means any place in a mine where miners are\n\nnormally required to work or travel;\n\n2. \"American table of distances\" means the 1971 edition of \"The\n\nAmerican Table of Distances for Storage of Explosives\" published by\n\nthe Institute of Makers of Explosives;\n\n3. \"ANFO\" means ammonium nitrate fuel oil mixtures;\n\n4. \"Approved\" means tested and accepted for a specific purpose\n\nby a nationally recognized safety agency;\n\n5. \"Barricaded\" means obstructed to restrict the passage of\n\npersons, vehicles or flying materials;\n\n6. \"Berm\" means a pile or mound of material capable of\n\nrestraining a vehicle; also a shelf, ledge or material placed to\n\ncontain loose slope material;\n\n7. \"Blasting agent\" means a cap insensitive chemical\n\ncomposition or mixture consisting of fuel and oxidizer and no\n\nexplosive ingredient but which can be made to detonate when\n\ninitiated with a high strength explosive primer;\n\n8. \"Blasting area\" means the area near blasting operations in\n\nwhich concussion or flying material can reasonably be expected to\n\ncause injury;\n\n9. \"Blasting cap\" means a detonator containing a charge of\n\ndetonating compound which is ignited by electric current or the\n\nspark of a fuse and is used for detonating explosives;\n\n10. \"Blasting circuit\" means electric current used to fire\n\nelectric detonators or to ignite an igniter cord by means of an\n\nelectric starter;\n\n11. \"Box-type magazine\" means a small, portable magazine used\n\nto store limited quantities of explosives or detonators for short\n\nperiods of time in locations at the mine which are convenient to the\n\nblasting sites at which they will be used;\n\n12. \"Capped fuse\" means a length of safety fuse to which a\n\ndetonator has been attached;\n\n13. \"Capped primer\" means a package or cartridge of explosives\n\nwhich is specifically designed to transmit detonation to other\n\nexplosives and which contains a detonator;\n\n14. \"Certified person\" means an individual who has\n\nsatisfactorily passed the required State Mining Board examination,\n\nthereby earning a certificate of competency which will allow him to\n\nwork in a particular position for which certification is necessary;\n\n15. \"Combustible\" means capable of being ignited and consumed\n\nby fire;\n\n16. \"Commercial mine\" means any mine from which the product is\n\nmined for sale, exchange or commercial use. Except as the context\n\nrequires otherwise, this act applies only to commercial mines;\n\n17. \"Company official\" means a member of the company\n\nsupervisory or technical staff;\n\n18. \"Department\" means the State of Oklahoma Department of\n\nMines;\n\n19. \"Detonator\" means a device containing a small detonating\n\ncharge that is used for detonating an explosive including, but not\n\nlimited to, blasting caps, exploders, electric detonators and delay\n\nelectric blasting caps;\n\n20. \"Distribution box\" means a portable apparatus with an\n\nenclosure through which an electric circuit is carried to one (1) or\n\nmore cables from a single incoming feedline, each cable circuit\n\nbeing connected through individual overcurrent protective devices;\n\n21. \"Electric blasting cap\" means a blasting cap designed for\n\nand capable of being initiated by means of an electric current;\n\n22. \"Electric grounding\" means to connect with the ground to\n\nmake the earth part of the circuit;\n\n23. \"Employee\" means a person who works for wages or salary in\n\nthe service of an employer;\n\n24. \"Employer\" means a person or organization employing one (1)\n\nor more persons to work for wages or salary;\n\n25. \"Explosive\" means any chemical compound, mixture or device,\n\nthe primary or common purpose of which is to function by explosion.\n\nExplosives include, but are not limited to, black powder, dynamite,\n\nnitroglycerin, fulminate and ammonium nitrate;\n\n26. \"Face\" or \"wall\" means that part of any mine where\n\nexcavating is progressing or was last done;\na Statutes - Title 45. Mines and Mining Page 128\n\n25. \"Explosive\" means any chemical compound, mixture or device,\n\nthe primary or common purpose of which is to function by explosion.\n\nExplosives include, but are not limited to, black powder, dynamite,\n\nnitroglycerin, fulminate and ammonium nitrate;\n\n26. \"Face\" or \"wall\" means that part of any mine where\n\nexcavating is progressing or was last done;\n\n27. \"Flammable\" means capable of being easily ignited and of\n\nburning rapidly as defined by the National Fire Protection\n\nAssociation;\n\n28. \"Highway\" means any public road or travelway used by the\n\ngeneral public;\n\n29. \"Igniter cord\" means a fuse, cordlike in appearance, which\n\nburns progressively along its length with an external flame at the\n\nzone of burning and is used for lighting a series of safety fuses in\n\nthe desired sequence;\n\n30. \"Inhabited building\" means a building regularly occupied in\n\nwhole or in part as a habitation for human beings, or any church,\n\nschoolhouse, railroad station, store, factory or other structure\n\nwhere people are accustomed to assemble, except any building or\n\nstructure occupied in connection with the manufacture,\n\ntransportation, storage or use of explosives;\n\n31. \"Inspector\" means a mine inspector in the employ of the\n\nState of Oklahoma;\n\n32. \"Magazine\" means a storage place for explosives or\n\ndetonators;\n\n33. \"Major electrical installation\" means an assemblage of\n\nstationary electrical equipment for the generation, transmission,\n\ndistribution or conversion of electric power;\n\n34. \"Misfire\" means the complete or partial failure of a\n\nblasting charge to explode as planned;\n\n35. \"Overburden\" means material of any nature, consolidated or\n\nunconsolidated, that overlies a deposit of useful materials or ores\n\nthat are to be mined;\n\n36. \"Owner\" means the owner, lessee, manager, superintendent,\n\noperator or agent, receiver or trustee operating any clay, coal or\n\ncopper mine;\n\n37. \"Primer\" or \"booster\" means a package or cartridge of\n\nexplosives designed specifically to transmit detonation to other\n\nexplosives but which does not contain a detonator;\n\n38. \"Reverse-current protection\" means a method or device used\n\non direct-current circuits of equipment to prevent the flow of\n\ncurrent in the reverse direction;\n\n39. \"Roll protection\" means a framework or safety canopy to\n\nprotect the vehicle operator if equipment should overturn;\n\n40. \"Safety can\" means an approved container of not over five\n\n(5) gallons capacity having a spring-closing lid and a spout cover;\n\n41. \"Safety fuse\" means a train of powder enclosed in cotton,\n\njute yarn and waterproofing compounds which burns at a uniform rate.\n\nIt is used for firing a cap containing the detonating compound which\n\nin turn sets off the explosive charge;\n\n42. \"Safety switch\" means a sectionalizing switch that also\n\nprovides shunt protection in blasting circuits between the blasting\n\nswitch and the shot area;\n\n43. \"Scaling\" means removal of insecure material from a face or\n\nhighwall;\n\n44. \"Secondary safety connection\" means a second connection\n\nbetween a conveyance and rope, intended to prevent the conveyance\n\nfrom running away or falling in the event the primary connection\n\nfails;\n\n45. \"Semiconductive hose\" means hose having an electrical\n\nresistance of not less than five thousand (5,000) ohms per foot and\n\nnot more than two (2) megohms for its total length, used in\n\npneumatic placement of blasting agents in boreholes;\n\n46. \"Sprung hole\" means a blasting hole chambered or enlarged\n\nto take an increased charge of explosives;\n\n47. \"Stemming\" means the inert material, and the placing of\n\nsuch material, on top of any charge of explosives;\n\n48. \"Stray current\" means that portion of a total electric\n\ncurrent that flows through paths other than the intended circuit;\n\n49. \"Strip or surface pit\" means the excavation in which\n\nsuperincumbent strata are removed exposing the natural deposit so it\nincreased charge of explosives;\n\n47. \"Stemming\" means the inert material, and the placing of\n\nsuch material, on top of any charge of explosives;\n\n48. \"Stray current\" means that portion of a total electric\n\ncurrent that flows through paths other than the intended circuit;\n\n49. \"Strip or surface pit\" means the excavation in which\n\nsuperincumbent strata are removed exposing the natural deposit so it\n\nmay be excavated and loaded by hand or by mechanical equipment in\n\nopen working. Strip or surface pits shall be subject to such mining\n\nlaws of the State of Oklahoma as apply to them, and such operations\n\nshall comply with recommendations for safety of employees made by\n\nthe Chief Mine Inspector;\n\n50. \"Substantial construction\" means construction of such\n\nstrength, material and workmanship that the object will withstand\n\nall reasonable shock, wear, usage and deterioration to which it will\n\nnormally be subjected;\n\n51. \"Suitable\" means that which fits and has the qualities or\n\nqualifications to normally meet a given purpose, occasion,\n\ncondition, function or circumstance; 52. \"Travelway\" means a\n\npassage, walk or way regularly used and designated for persons to go\n\nfrom one place to another while at work;\n\n53. Voltage:\n\na. \"low voltage\" means up to and including 660\n\nvolts,\n\nb. \"medium voltage\" means from 661 to 1,000 volts,\n\nand\n\nc. \"high voltage\" means more than 1,000 volts;\n\n54. \"Wet drilling\" means the continuous application of water\n\nto the back or bottom of the drill holes while drilling; and\n\n55. \"Working place\" means any place in or about a mine where\n\nwork is being performed.","path":["OK Code","Title 45"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os45.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"080e51a8ca0d15c41d0aa0bd98e504451661b0f4e0624999d5bc02c994cf1635","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-45-45-9.1","next":"us-ok/okla.-stat.-tit.-45-45-902"},"notice":"GroundRules: Original legal text.
