All fly ash, bottom ash or any other such material produced\n\nby coal combustion, power-generating facilities shall be exempt from\n\nall solid waste permitting requirements pursuant to Title 27A of the\n\nOklahoma Statutes, provided such ash is constructively reutilized,\n\nor disposed of in any active or inactive coal mining operation\n\nsubject to the provisions contained in Title 45 of the Oklahoma\n\nStatutes. The disposal of fly ash, bottom ash or any other such\n\nmaterial generated by the burning of coal for the purpose of\n\ngenerating electricity by electric utilities and independent power\n\nproducers in any noncoal mining operation shall be subject to the\n\nsolid waste permitting requirements in Title 27A of the Oklahoma\n\nStatutes.\n\nB.
