Stat. tit. 46, § 46-12","heading":"Assignment - Unrecorded - Payment","body":"In cases where assignments of real estate mortgages are made\n\nafter the passage of this act, if such assignments are not recorded,\n\nthe mortgagor, his heirs, personal representatives, or assigns, may\n\npay all matured interest or the principal debt secured thereby,\n\nprior to the recording of such assignment to the mortgagee, or if\n\nany assignment of such mortgage has been made that duly appears of\n\nrecord, then such payment may be made to the last assignee whose\n\nassignment is recorded in accordance with the provisions of this\n\nact, and such payment shall be effectual to extinguish the debt\n\nsecured by such mortgage and all claims against such mortgagor, his\n\nheirs, personal representatives, and assigns, for or on account of\n\nsuch interest or such principal indebtedness; and no transfer of any\n\nnote, bond or other evidence of indebtedness, by endorsement or\n\notherwise, where such indebtedness is secured by mortgage on real\n\nestate within this state, shall prevent or operate to defeat the\n\ndefense of payment of such interest or principal by the mortgagor,\n\nhis heirs, personal representatives, or assigns, where such payment\n\nhas been made to the mortgagee or to the assignee whose assignment\n\nappears last of record under the provisions of this act: Provided,\n\nhowever, that in all such cases the assignee who may hold such\n\nunrecorded assignment shall have a right of action against his\n\nassignor to recover the amount of any such payment of interest or\n\nprincipal made to such assignor as upon an account for money had and\n\nreceived for the use of such assignee: Provided, this section\n\napplies only to mortgages which have been on record six (6) months\n\nor more.","path":["OK Code","Title 46"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os46.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f984db99e4f5a78bac33cd30d355c4d627f5f4d5f4599f2d2a3c1290988e4eb4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-46-46-11","next":"us-ok/okla.-stat.-tit.-46-46-13"},"notice":"GroundRules: Original legal text.
