Stat. tit. 46, § 46-42","heading":"Definitions","body":"As used in this act:\n\n1. \"Date of sale\" means the date that the mortgagee conducts\n\nthe public auction of the property pursuant to Section 46 of this\n\ntitle;\n\n2. \"Homestead\" means the property that constitutes the\n\nmortgagor's homestead according to the provisions of Section 1 of\n\nArticle XII of the Oklahoma Constitution and statutes enacted\n\npursuant thereto determined at the time the mortgagor makes any\n\nelection under subsection A of Section 43 of this title;\n\n3. \"Mortgage\" means an instrument creating a lien upon real\n\nestate as security for payment of a debt or other performance of an\n\nobligation;\n\n4. \"Mortgagee\" includes a successor or assignee and, if\n\nappropriate in the context, an agent or officer or attorney for the\n\nmortgagee;\n\n5. \"Mortgagor\" means all persons who to the knowledge of the\n\nmortgagee owe payment or other performance of the obligation secured\n\nby the mortgage, and, for the purpose of receipt of notice, includes\n\na surety, guarantor or co-signer, but if the mortgagor and the owner\n\nof the real estate are not the same person, the term means the owner\n\nof the real estate, the obligor, or both as the context requires;\n\n6. \"Property\" means the real estate subject to a mortgage; and\n\n7. \"Real estate\" means any estate in, over, or under land,\n\nincluding minerals, structures, fixtures, and other things which by\n\ncustom, usage, or law pass with a conveyance of land though not\n\ndescribed or mentioned in the instrument of conveyance.","path":["OK Code","Title 46"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os46.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1500b4798e502b6b1847472f9725142554698ae419a2f91ab881433f4528712d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-46-46-41","next":"us-ok/okla.-stat.-tit.-46-46-43"},"notice":"GroundRules: Original legal text.
