A \"motorized scooter\" is any vehicle having:\n\n1. Not more than three wheels in contact with the ground;\n\n2. Handlebars and a foot support or seat for the use of the\n\noperator; and\n\n3. A power source that is capable of propelling the vehicle at\n\na maximum design speed of not more than thirty-five (35) miles per\n\nhour on level ground, and:\n\na. if the power source is a combustion engine, has a\n\npiston or rotor displacement of fifty cubic\n\ncentimeters (50 cc) or less regardless of the number\n\nof chambers in the power source, or\n\nb. if the power source is electric, is programmed by the\n\nmanufacturer not to exceed thirty-five (35) miles per\n\nhour on level ground.\n\nRegardless of power source, local governments may set maximum speed\n\nrequirements by local ordinance.\n\nB. For purposes of this section, an electric personal assistive\n\nmobility device, as defined in Section 1-114A of this title,\n\nbicycle, electric-assisted bicycle, or motorized bicycle, as defined\n\nin Section 1-104 of this title, shall not be considered a motorized\n\nscooter.\n\nC. A motorized scooter shall not be required to be registered\n\nunder the laws of this state.\n\n1. The operator of a motorized scooter shall be at least\n\nfourteen (14) years of age unless an older age is required by local\n\nordinance.\n\n2. The operator of a motorized scooter shall not be required to\n\npossess a driver license unless required by local ordinance.\n\n3. The operator of a motorized scooter shall not be required to\n\ncomply with the vehicle insurance or financial responsibility laws\n\nof this state unless required by local ordinance, and shall observe\n\nall applicable traffic safety regulations when driving on a public\n\nroadway as required by statute and local ordinances.\n\nD.
