A person shall not operate a transportation network company\n\nin Oklahoma without first having obtained a permit from the Oklahoma\n\nCorporation Commission (Commission).\n\nB. The Commission shall issue a permit to each applicant that\n\npresents proof, in a form prescribed by the Commission, that the\n\napplicant meets the requirements for a TNC set forth in this act,\n\nand proof of insurance required by this act and pays to the\n\nCommission an annual permit fee of Five Thousand Dollars\n\n($5,000.00).\n\nC. The Commission shall promulgate rules as needed to implement\n\nthe provisions of this act. The Commission may also set additional\n\nfees and assess fines for noncompliance with this act or with\n\npromulgated rules.\n\nD. The authority of the Commission shall be limited to\n\npermitting and regulation of TNCs to ensure compliance by TNCs with\n\nthe provisions of this act and shall not include jurisdiction to\n\nadjudicate private causes of action arising from the provision of\n\nprearranged rides.\n\nE. The Commission shall have the authority to examine the\n\nrecords of TNCs for the purpose of enforcement of this act,\n\nincluding a random sample of the TNC's records related to\n\nprearranged rides and TNC drivers at the Oklahoma City offices of\n\nthe Commission, unless an alternative location is agreed to by the\n\nCommission and the TNC. Such examinations shall not occur more than\n\ntwo times per year unless necessary to investigate a complaint.\n\nRecords obtained by the Commission pursuant to this act shall not be\n\nsubject to disclosure under the Oklahoma Open Records Act and shall\n\nbe kept confidential by the Commission, except as may be required in\n\na Commission proceeding.\n\nF.
