Prior to permitting an individual to act as a transportation\n\nnetwork company driver on its digital network, the TNC shall:\n\n1. Require the individual to submit an application to the TNC,\n\nwhich includes information regarding his or her address, age, driver\n\nlicense, driving history, motor vehicle registration, automobile\n\nliability insurance, and other information required by the TNC;\n\n2. Conduct, or have a third party conduct, a local and national\n\ncriminal background check for each applicant that shall include a\n\ncheck of:\n\na. the Multi-State/Multi-Jurisdictional Criminal Records\n\nLocator or other similar commercial nationwide\n\ndatabase with validation through a primary source\n\nsearch, and\n\nb. the National Sex Offender Registry database; and\n\n3. Obtain and review a driving history research report for such\n\nindividual.\n\nB. TNCs shall not permit an individual to act as a TNC driver\n\non its digital network who:\n\n1. Has had more than three moving violations in the prior\n\nthree-year period, or one major violation, including but not limited\n\nto attempting to evade the police, reckless driving, or driving on a\n\nsuspended or revoked license, in the prior three-year period;\n\n2. Has been convicted, within the past seven (7) years, of\n\ndriving under the influence of drugs or alcohol, fraud, sexual\n\noffenses, use of a motor vehicle to commit a felony, a crime\n\ninvolving property damage, theft, acts of violence, or acts of\n\nterror;\n\n3. Is a match in the National Sex Offender Registry database;\n\n4. Does not possess a valid driver license;\n\n5. Does not possess current proof of motor vehicle registration\n\nfor the motor vehicle(s) used to provide prearranged rides;\n\n6. Does not possess proof of the automobile liability insurance\n\nrequired by law or rule for the motor vehicle(s) used to provide\n\nprearranged rides; or\n\n7. Is not at least nineteen (19) years of age.\n\nC.
