On or before July 1, 2015, and thereafter, a transportation\n\nnetwork company driver or TNC on the TNC driver’s behalf shall\n\nmaintain primary automobile insurance that recognizes that the\n\ndriver is a TNC driver or otherwise uses a vehicle to transport\n\npassengers for compensation and covers the driver:\n\n1. While the driver is both logged on to and available to\n\nreceive transportation requests on the TNC’s digital network; or\n\n2. While the driver is engaged in providing prearranged rides.\n\nB. The following automobile insurance requirements shall apply\n\nwhile a TNC driver is both logged on to the TNC’s digital network\n\nand available to receive transportation requests but is not engaged\n\nin prearranged rides:\n\n1. Primary automobile liability insurance in the amount of at\n\nleast Fifty Thousand Dollars ($50,000.00) for death and bodily\n\ninjury per person, One Hundred Thousand Dollars ($100,000.00) for\n\ndeath and bodily injury per incident, and Twenty-five Thousand\n\nDollars ($25,000.00) for property damage;\n\n2. Uninsured motorist coverage where not waived pursuant to\n\nSection 3636 of Title 36 of the Oklahoma Statutes; and\n\n3. The coverage requirements of this subsection may be\n\nsatisfied by any of the following:\n\na. automobile insurance maintained by the TNC driver,\n\nb. automobile insurance maintained by the TNC, or\n\nc. any combination of subparagraphs a and b of this\n\nparagraph.\n\nC. The following automobile insurance requirements shall apply\n\nwhile a TNC driver is engaged in a prearranged ride:\n\n1. Primary automobile liability insurance that provides at\n\nleast One Million Dollars ($1,000,000.00) for death, bodily injury,\n\nand property damage;\n\n2. Uninsured motorist coverage where not waived pursuant to\n\nSection 3636 of Title 36 of the Oklahoma Statutes; and\n\n3. The coverage requirements of this subsection may be\n\nsatisfied by any of the following:\n\na. automobile insurance maintained by the TNC driver,\n\nb. automobile insurance maintained by the TNC, or\n\nc. any combination of subparagraphs a and b of this\n\nparagraph.\n\nD. If insurance maintained by a TNC driver in subsection B or C\n\nof this section has lapsed or does not provide the required\n\ncoverage, insurance maintained by a TNC shall provide the coverage\n\nrequired by this section beginning with the first dollar of a claim\n\nand have the duty to defend such claim.\n\nE. Coverage under an automobile insurance policy maintained by\n\nthe TNC shall not be dependent on a personal automobile insurer\n\nfirst denying a claim nor shall a personal automobile insurance\n\npolicy be required to first deny a claim.\n\nF. Insurance required by this section may be placed with an\n\ninsurer authorized to do business in this state or with a surplus\n\nlines insurer eligible under Section 1100 et seq. of Title 36 of the\n\nOklahoma Statutes.\n\nG. Insurance satisfying the requirements of this section shall\n\nbe deemed to satisfy the financial responsibility requirement for a\n\nmotor vehicle under Chapter 7 of the Oklahoma Highway Safety Code of\n\nSection 7-101 et seq. of this title, while the TNC driver is logged\n\ninto the network.\n\nH. A TNC driver shall carry proof of coverage satisfying\n\nsubsections B and C of this section with him or her at all times\n\nduring his or her use of a vehicle in connection with a\n\ntransportation network company’s digital network. Proof of coverage\n\nmay be presented in electronic format. In the event of an accident,\n\na TNC driver shall provide this insurance coverage information to\n\nthe directly interested parties, automobile insurers and\n\ninvestigating police officers, upon request pursuant to Section 7-\n\n102 et seq. of this title.
