Insurers that write automobile insurance in Oklahoma may\n\nexclude any and all coverage afforded under the owner's insurance\n\npolicy for any loss or injury that occurs while a transportation\n\nnetwork company driver is logged on to a TNC's digital network or\n\nwhile a driver provides a prearranged ride. This right to exclude\n\nall coverage may apply to any coverage included in an automobile\n\ninsurance policy including, but not limited to:\n\n1. Liability coverage for bodily injury and property damage;\n\n2. Uninsured and underinsured motorist coverage;\n\n3. Medical payments coverage;\n\n4. Comprehensive physical damage coverage; and\n\n5. Collision physical damage coverage.\n\nB. Such exclusions shall apply notwithstanding any requirement\n\nunder Chapter 7 of the Oklahoma Highway Safety Code of Section 7-101\n\net seq. of Title 47 of the Oklahoma Statutes. Nothing in this\n\nsection implies or requires that a personal automobile insurance\n\npolicy provide coverage while the TNC driver is logged on to the\n\nTNC's digital network, while the TNC driver is engaged in a\n\nprearranged ride or while the driver otherwise uses a vehicle to\n\ntransport passengers for compensation.\n\nNothing shall be deemed to preclude an insurer from providing\n\ncoverage for the TNC driver's vehicle, if it chooses to do so by\n\ncontract or endorsement.\n\nC. Automobile insurers that exclude coverage as permitted in\n\nSection 16 of this act shall have no duty to defend or indemnify any\n\nclaim expressly excluded thereunder. Nothing in this article shall\n\nbe deemed to invalidate or limit an exclusion contained in a policy\n\nalready in use or approved for use in this state prior to the\n\nenactment of this act that excludes coverage for vehicles used to\n\ncarry persons or property for a charge or available for hire by the\n\npublic.\n\nAn automobile insurer that defends or indemnifies a claim\n\nagainst a TNC driver that is excluded under the terms of its policy\n\nshall have a right of contribution against other insurers that\n\nprovide automobile insurance to the same TNC driver in satisfaction\n\nof the coverage requirements of Section 16 of this act at the time\n\nof loss.\n\nD. In a claims coverage investigation, TNCs and any insurer\n\npotentially providing coverage under Section 16 of this act shall\n\ncooperate to facilitate the exchange of relevant information with\n\ndirectly involved parties and any insurer of the TNC driver if\n\napplicable, including the precise times that a TNC driver logged on\n\nand off of the TNC's digital network in the twelve-hour period\n\nimmediately preceding and in the twelve-hour period immediately\n\nfollowing the accident and disclose to one another a clear\n\ndescription of the coverage, exclusions and limits provided under\n\nany automobile insurance maintained under Section 16 of this act.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"35c7c10bbda304ffcf6179959ba306132380337c00064f0284e6f63a225054e2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-1026","next":"us-ok/okla.-stat.-tit.-47-47-1028"},"notice":"GroundRules: Original legal text.
