Stat. tit. 47, § 47-1030","heading":"Exclusive jurisdiction of the Oklahoma Corporation","body":"Commission.\n\nA. Notwithstanding any other provision of law, the regulation,\n\nlicensing or permitting of transportation network companies for the\n\nprovisions of prearranged rides is within the exclusive jurisdiction\n\nof the Oklahoma Corporation Commission as set forth in the Oklahoma\n\nTransportation Network Company Services Act and any rules\n\npromulgated by the Commission consistent with the act. No political\n\nsubdivision of the state may impose a tax on, or require a license\n\nfor, a Transportation Network Company (TNC) or a TNC driver for the\n\nprovision of prearranged rides or subject a TNC to the political\n\nsubdivision's rate requirement, entry requirement, operational\n\nrequirement or other requirements.\n\nB. All TNC drivers shall be independent contractors and not\n\nemployees of the TNC if all of the following conditions are met:\n\n1. The TNC does not prescribe specific hours during which a TNC\n\ndriver must be logged into the TNC's digital network;\n\n2. The TNC imposes no restrictions on the TNC driver's ability\n\nto utilize digital networks from other TNCs;\n\n3. The TNC does not restrict a TNC driver from engaging in any\n\nother occupation or business; and\n\n4.
