A peer-to-peer car sharing program shall ensure that, during\n\neach car sharing period, the shared vehicle owner and the shared\n\nvehicle driver are insured under a motor vehicle liability insurance\n\npolicy that provides insurance coverage in amounts no less than the\n\nminimum amounts set forth in Section 7-600 et seq. of Title 47 of\n\nthe Oklahoma Statutes, and:\n\n1. Recognizes that the shared vehicle insured under the policy\n\nis made available and used through a peer-to-peer car sharing\n\nprogram; or\n\n2. Does not exclude use of a shared vehicle by a shared vehicle\n\ndriver.\n\nB. The insurance required under subsection A of this section\n\nmay be satisfied by motor vehicle liability insurance maintained by:\n\n1. A shared vehicle owner;\n\n2. A shared vehicle driver;\n\n3. A peer-to-peer car sharing program; or\n\n4. Any combination of a shared vehicle owner, a shared vehicle\n\ndriver and a peer-to-peer car sharing program.\n\nC. The insurance required in subsection B of this section, that\n\nis satisfying the requirement of subsection A of this section, shall\n\nbe primary during each car sharing period, and in the event that a\n\nclaim occurs in another state with minimum financial responsibility\n\nlimits higher than those provided pursuant to Section 7-600 et seq.\n\nof Title 47 of the Oklahoma Statutes, during the car sharing period,\n\nthe coverage maintained under subsection E of this section shall\n\nsatisfy the difference in minimum coverage amounts, up to the\n\napplicable policy limits.\n\nD. The insurer, insurers, or peer-to-peer car sharing program\n\nproviding coverage under subsection A or B of this section shall\n\nassume primary liability for a claim when:\n\n1. A dispute exists as to who was in control of the shared\n\nmotor vehicle at the time of the loss and the peer-to-peer car\n\nsharing program does not have available, did not retain, or fails to\n\nprovide the information required by Section 5 of this act; or\n\n2. A dispute exists as to whether the shared vehicle was\n\nreturned to the alternatively agreed upon location as required under\n\nSection 2 of this act.\n\nE. If insurance maintained by a shared vehicle owner or shared\n\nvehicle driver in accordance with subsection B of this section has\n\nlapsed or does not provide the required coverage, insurance\n\nmaintained by a peer-to-peer car sharing program shall provide the\n\ncoverage required by subsection A of this section beginning with the\n\nfirst dollar of a claim and shall have the duty to defend such claim\n\nexcept under circumstances as set forth in subsection B of Section 3\n\nof this act.\n\nF. Coverage under an automobile insurance policy maintained by\n\nthe peer-to-peer car sharing program shall not be dependent on\n\nanother automobile insurer first denying a claim, nor shall another\n\nautomobile insurance policy be required to first deny a claim.\n\nG. Nothing in the Peer-to-Peer Car Sharing Program Act shall:\n\n1. Limit the liability of the peer-to-peer car sharing program\n\nfor any act or omission of the program itself that results in injury\n\nto any person as a result of the use of a shared vehicle through a\n\npeer-to-peer car sharing program; or\n\n2. Limit the ability of the peer-to-peer car sharing program\n\nto, by contract, seek indemnification from the shared vehicle owner\n\nor the shared vehicle driver for economic loss sustained by the\n\npeer-to-peer car sharing program resulting from a breach of the\n\nterms and conditions of the car sharing program agreement.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"42f341a9a19a6b4a804519b513771bdc2020dda87452ab6333a748a8afbc6ace","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-1052","next":"us-ok/okla.-stat.-tit.-47-47-1054"},"notice":"GroundRules: Original legal text.
