A person shall be guilty of the offense of endangerment of a\n\nhighway worker if the person commits any of the following when the\n\nact occurs within a maintenance or construction zone:\n\n1. Exceeding the posted speed limit by fifteen (15) miles per\n\nhour or more;\n\n2. Failing to merge as required in subsection D of Section 11-\n\n1302 of Title 47 of the Oklahoma Statutes;\n\n3. Failing to stop for a work-zone flagman or failing to obey\n\ntraffic-control devices that have been erected for purposes of\n\nwarning or guiding the public into and through the construction or\n\nmaintenance area;\n\n4. Driving through or around a construction or maintenance area\n\nby any lane not clearly designated to motorists for the flow of\n\ntraffic through or around the construction or maintenance area; or\n\n5. Intentionally striking, moving or altering barrels,\n\nbarriers, signs, or other devices erected to control the flow of\n\ntraffic to protect highway workers and motorists in the construction\n\nor maintenance area for a reason other than avoidance of an\n\nobstacle, an emergency, or to protect the health and safety of an\n\noccupant of the motor vehicle or of another person.\n\nB. Upon conviction for committing the offense of endangerment\n\nof a highway worker pursuant to subsection A of this section, if no\n\ninjury or death of a highway worker resulted from the offense, in\n\naddition to any other penalty authorized by law, the person shall be\n\nsubject to a fine of not more than One Thousand Dollars ($1,000.00).\n\nC. A person shall be deemed to commit the offense of aggravated\n\nendangerment of a highway worker upon conviction for any offense\n\npursuant to subsection A of this section when such offense occurs in\n\na construction or maintenance area and results in the injury or\n\ndeath of a highway worker. Upon conviction for committing the\n\noffense of aggravated endangerment of a highway worker, in addition\n\nto any other penalty authorized by law, the person shall be subject\n\nto a fine of not more than Five Thousand Dollars ($5,000.00) if the\n\noffense resulted in injury to a highway worker and not more than Ten\n\nThousand Dollars ($10,000.00) if the offense resulted in the death\n\nof a highway worker.\n\nD. Except for the offense provided for in paragraph 5 of\n\nsubsection A of this section, no person shall be deemed to commit\n\nthe offense of endangerment of a highway worker except when the act\n\nor omission constituting the offense occurred when one or more\n\nhighway workers were in the construction or maintenance area.\n\nE. No person shall be cited or convicted for endangerment of a\n\nhighway worker or aggravated endangerment of a highway worker, for\n\nany act or omission otherwise constituting an offense under\n\nsubsection A of this section, if such act or omission resulted, in\n\nwhole or in part, from mechanical failure of the vehicle of the\n\nperson or from the negligence of another person or a highway worker.\n\nF. Upon the expiration of any contract for maintenance or\n\nconstruction on a section of roadway, any increased fines or\n\npenalties otherwise imposed by law shall not apply.\n\nG.
