Stat. tit. 47, § 47-11-314","heading":"Short title — Bernardo-Mills Law — Approaching","body":"stationary authorized vehicles on the roadway.\n\nA. This section shall be known and may be cited as the\n\n\"Bernardo-Mills Law\".\n\nB. The driver of a motor vehicle, upon approaching a stationary\n\nauthorized emergency vehicle, a Department of Transportation\n\nmaintenance vehicle, a Turnpike Authority maintenance vehicle, a\n\nstationary vehicle that is displaying flashing lights or a licensed\n\nwrecker that is displaying a flashing amber light, a combination red\n\nor blue light or any combination of amber, red or blue lights,\n\nshall:\n\n1. If traveling on a highway that consists of two or more lanes\n\nthat carry traffic in the same direction of travel as that of the\n\ndriver, the driver shall proceed with due caution and shall, if\n\npossible and with due regard to the road, weather, and traffic\n\nconditions, change lanes into a lane that is not adjacent to the\n\nstationary authorized emergency vehicle, a Department of\n\nTransportation maintenance vehicle, a Turnpike Authority maintenance\n\nvehicle, or licensed wrecker; or if the driver is not able to change\n\nlanes or if to do so would be unsafe, the driver shall proceed with\n\ndue caution and reduce the speed of the motor vehicle to a safe\n\nspeed; and\n\n2. If traveling on a highway other than a highway described in\n\nparagraph 1 of this subsection, the driver shall proceed with due\n\ncaution and reduce the speed of the motor vehicle to a safe speed.\n\nA person shall be guilty of the offense of endangerment of an\n\nemergency worker for any offense committed in violation of this\n\nsubsection.\n\nC. This section does not relieve the operator of a stationary\n\nauthorized emergency vehicle, a Department of Transportation\n\nmaintenance vehicle, a Turnpike Authority maintenance vehicle, or\n\nlicensed wrecker from the consequences of reckless disregard for the\n\nsafety of all persons and property upon the highway.\n\nD. Upon conviction for committing the offense of endangerment\n\nof an emergency worker pursuant to subsection B of this section, if\n\nno injury or death of an emergency worker resulted from the offense,\n\nand in addition to any other penalty authorized by law, the person\n\nshall be subject to a fine of:\n\n1. One Thousand Dollars ($1,000.00) for a first offense; and\n\n2. Two Thousand Five Hundred Dollars ($2,500.00) for a second\n\noffense.\n\nE. A person shall be deemed to commit the offense of aggravated\n\nendangerment of an emergency worker upon conviction for any offense\n\npursuant to subsection B of this section when such offense results\n\nin the injury or death of an emergency worker. Upon conviction for\n\ncommitting the offense of aggravated endangerment of an emergency\n\nworker, in addition to any other penalty authorized by law, the\n\nperson shall be subject to a fine of not more than Five Thousand\n\nDollars ($5,000.00) if the offense resulted in injury to an\n\nemergency worker and not more than Ten Thousand Dollars ($10,000.00)\n\nif the offense resulted in the death of an emergency worker.\n\nF. No person shall be cited or convicted for endangerment of an\n\nemergency worker or aggravated endangerment of an emergency worker\n\nfor any act or omission otherwise constituting an offense under\n\nsubsection B of this section if such act or omission resulted, in\n\nwhole or in part, from mechanical failure of the vehicle of the\n\nperson or from the negligence of another person or an emergency\n\nworker.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5f61268cbc9b0327bb6b32516b90b8b2acec3edc721d8a0572d9ced09a5dee8c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-11-313","next":"us-ok/okla.-stat.-tit.-47-47-11-315"},"notice":"GroundRules: Original legal text.
