Any person driving a vehicle on a highway shall drive at a\n\ncareful and prudent speed not greater than nor less than is\n\nreasonable and proper, having due regard to the traffic, surface,\n\nand width of the highway and any other conditions then existing. No\n\nperson shall drive any vehicle upon a highway at a speed greater\n\nthan will permit the driver to bring it to a stop within the assured\n\nclear distance ahead.\n\nB. Except when a special hazard exists that requires lower\n\nspeed for compliance with subsection A of this section, the limits\n\nspecified by law or established as hereinafter authorized shall be\n\nmaximum lawful speeds, and no person shall drive a vehicle at a\n\nspeed in excess of the following maximum limits:\n\n1. On a highway, part of a highway, or on roads located on\n\nlands owned by a state beneficiary public trust, unless otherwise\n\nestablished in law, a speed established by the Department of\n\nTransportation on the basis of engineering and traffic\n\ninvestigations used to determine the speed that is reasonable and\n\nsafe under the conditions found to exist on the highway, part of the\n\nhighway, or road;\n\n2. For a school bus, fifty-five (55) miles per hour on paved\n\ntwo-lane roads except on the state highway system, the interstate\n\nhighway system, and the turnpike system where the maximum shall be\n\nsixty-five (65) miles per hour;\n\n3. On any highway outside of a municipality in a properly\n\nmarked school zone, twenty-five (25) miles per hour, during certain\n\ntimes as provided in Section 11-806.1 of this title and provided the\n\nzone is marked with appropriate warning signs placed in accordance\n\nwith the latest edition of the Manual on Uniform Traffic Control\n\nDevices for Streets and Highways. The Department of Transportation\n\nmay determine on the basis of an engineering and traffic\n\ninvestigation that a speed limit higher than twenty-five (25) miles\n\nper hour may be reasonable and safe under conditions as they exist\n\nupon a highway, and post an alternative school zone speed limit.\n\nThe Department shall mark such school zones, or entrances and exits\n\nonto highways by buses or students, so that the maximum speed\n\nprovided by this paragraph shall be established therein. Exits and\n\nentrances to controlled-access highways which are within such school\n\nzones shall be marked in the same manner as other highways. The\n\ncounty commissioners shall mark such school zones along the county\n\nroads so that the maximum speed provided by this paragraph shall be\n\nestablished therein. The signs may be either permanent or\n\ntemporary. The Department shall give priority over all other\n\nsigning projects to the foregoing duty to mark school zones. The\n\nDepartment shall also provide other safety devices for school zones\n\nwhich are needed in the opinion of the Department;\n\n4. Twenty-five (25) miles per hour or a posted alternative\n\nschool zone speed limit through state schools located on the state-\n\nowned land adjoining or outside the limits of a corporate city or\n\ntown where a state educational institution is established;\n\n5. Thirty-five (35) miles per hour on a highway in any state\n\npark or wildlife refuge. Provided, however, that the provisions of\n\nthis paragraph shall not include the State Capitol Park area, and no\n\nperson shall drive any vehicle at a rate of speed in excess of\n\nfifty-five (55) miles per hour on any state or federal designated\n\nhighway within such areas; and\n\n6. For any vehicle or combination of vehicles with solid rubber\n\nor metal tires, ten (10) miles per hour.\n\nThe maximum speed limits set forth in this section may be\n\naltered as authorized in Sections 11-802 and 11-803 of this title.\n\nC. The Transportation Commission is hereby authorized to\n\nprescribe maximum and minimum speeds for all vehicles and any\n\ncombinations of vehicles using controlled-access highways. Such\nor combination of vehicles with solid rubber\n\nor metal tires, ten (10) miles per hour.\n\nThe maximum speed limits set forth in this section may be\n\naltered as authorized in Sections 11-802 and 11-803 of this title.\n\nC. The Transportation Commission is hereby authorized to\n\nprescribe maximum and minimum speeds for all vehicles and any\n\ncombinations of vehicles using controlled-access highways. Such\n\nregulations shall become effective after signs have been posted on\n\nthese highways giving notice thereof. Such regulations may apply to\n\nan entirely controlled-access highway or to selected sections\n\nthereof as may be designated by the Transportation Commission. A\n\nspeed limit of seventy-five (75) miles per hour may be set in\n\nlocations comprising rural segments of the interstate highway system\n\nby the Transportation Commission; provided, however, that speed is\n\ndetermined to be safe and reasonable after a traffic or engineering\n\nstudy has been completed by the Department. It shall be a violation\n\nof this section to drive any vehicle at a faster rate of speed than\n\nsuch prescribed maximum or at a slower rate of speed than such\n\nprescribed minimum. However, all vehicles shall at all times\n\nconform to the limits set forth in this section.\n\nCopies of such regulations certified as in effect on any\n\nparticular date by the Secretary of the Transportation Commission\n\nshall be accepted as evidence in any court in this state. Whenever\n\nchanges have been made in speed zones, copies of such regulations\n\nshall be filed with the Commissioner of Public Safety.\n\nD. The Oklahoma Turnpike Authority is hereby authorized to\n\nprescribe maximum and minimum speeds for trucks, buses and\n\nautomobiles using turnpikes; provided, however, a speed limit of\n\neighty (80) miles per hour may be set in locations comprising the\n\nturnpike system, as may be approved by the Authority. The\n\nregulation pertaining to automobiles shall apply to all vehicles not\n\ncommonly classified as either trucks or buses. Such regulations\n\nshall become effective only after approval by the Commissioner of\n\nPublic Safety, and after signs have been posted on the turnpike\n\ngiving notice thereof. Such regulations may apply to an entire\n\nturnpike project or to selected sections thereof as may be\n\ndesignated by the Oklahoma Turnpike Authority. It shall be a\n\nviolation of this section to drive a vehicle at a faster rate of\n\nspeed than such prescribed maximum speed or at a slower rate of\n\nspeed than such prescribed minimum speed. However, all vehicles\n\nshall at all times conform to the requirements of this section.\n\nCopies of such regulations, certified as in effect on any\n\nparticular date by the Secretary of the Oklahoma Turnpike Authority,\n\nshall be accepted in evidence in any court in this state.\n\nE. The driver of every vehicle shall, consistent with the\n\nrequirements of subsection A of this section, drive at an\n\nappropriate reduced speed when approaching and crossing an\n\nintersection or railway grade crossing, when approaching and going\n\naround a curve, when approaching a hillcrest, when driving upon any\n\nnarrow or winding roadway, and when special hazard exists with\n\nrespect to pedestrians or other traffic, or by reason of weather or\n\nhighway conditions. The Department of Transportation and the\n\nOklahoma Turnpike Authority may post, by changeable message sign or\n\nother appropriate sign, a temporary reduced speed limit for\n\nmaintenance operations or when special hazards with respect to\n\npedestrians, other traffic, an accident, by reason of weather, or\n\nother hazardous highway conditions exist.\n\nF. 1. No person shall drive a vehicle on a county road at a\n\nspeed in excess of fifty-five (55) miles per hour unless posted\n\notherwise by the board of county commissioners, as provided in\n\nsubparagraphs a through c of this paragraph, as follows:\n\na. the board of county commissioners may determine, by\nother traffic, an accident, by reason of weather, or\n\nother hazardous highway conditions exist.\n\nF. 1. No person shall drive a vehicle on a county road at a\n\nspeed in excess of fifty-five (55) miles per hour unless posted\n\notherwise by the board of county commissioners, as provided in\n\nsubparagraphs a through c of this paragraph, as follows:\n\na. the board of county commissioners may determine, by\n\nresolution, a maximum speed limit which shall apply to\n\nall county roads which are not otherwise posted for\n\nspeed,\n\nb. the board of county commissioners shall provide public\n\nnotice of the speed limit on all nonposted roads by\n\npublication in a newspaper of general circulation in\n\nthe county. The notice shall be published once weekly\n\nfor a period of four (4) continuous weeks, and\n\nc. the board of county commissioners shall forward the\n\nresolution to the Director of the Department and to\n\nthe Commissioner of Public Safety.\n\n2. The Department shall post speed limit information, as\n\ndetermined pursuant to the provisions of subparagraphs a through c\n\nof paragraph 1 of this subsection, on the county line marker where\n\nany state highway enters a county and at all off-ramps where\n\ninterstate highways or turnpikes enter a county. The signs shall\n\nread as follows:\n\nENTERING __________ COUNTY\n\nCOUNTY ROAD SPEED LIMIT\n\n_____ MPH\n\nUNLESS POSTED OTHERWISE\n\nThe appropriate board of county commissioners shall reimburse\n\nthe Department the full cost of the signage required herein.\n\nG. Any person convicted of a speeding violation pursuant to\n\nsubsection B or F of this section shall be punished by a fine as\n\nfollows:\n\n1. One (1) to ten (10) miles per hour over the speed limit as\n\nprovided for in Section 11-801e of this title;\n\n2. Eleven (11) to fifteen (15) miles per hour\n\n3. Sixteen (16) to twenty (20) miles per hour\n\n4. Twenty-one (21) to twenty-five (25) miles per\n\n5. Twenty-six (26) to thirty (30) miles per hour\n\n6. Thirty-one (31) to thirty-five (35) miles per\n\n7. Thirty-six (36) miles per hour or more over\n\nor by imprisonment for not more than ten (10) days; for a second\n\nconviction within one (1) year after the first conviction, by\n\nimprisonment for not more than twenty (20) days; and upon a third or\n\nsubsequent conviction within one (1) year after the first\n\nconviction, by imprisonment for not more than six (6) months, or by\n\nboth such fine and imprisonment.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"15fcdca9732fdbedc1ece2cc597e7b4d4ddce4b7aa37633112ebf254c687feaa","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-11-705.1","next":"us-ok/okla.-stat.-tit.-47-47-11-801b"},"notice":"GroundRules: Original legal text.
