Stat. tit. 47, § 47-11-805.3","heading":"Electric personal assistive mobility devices -","body":"Registration - Operation requirements - Warning notice.\n\nA. Notwithstanding any other provisions of law, an electric\n\npersonal assistive mobility device, as defined in Section 1 of this\n\nact, shall not be:\n\n1. Registered pursuant to the Oklahoma Vehicle License and\n\nRegistration Act; or\n\n2. Operated on the highways or turnpikes of this state except\n\nas provided in subsection B of this section.\n\nB. An electric personal assistive mobility device may be\n\noperated upon the sidewalks, walking trails, bikeways, and municipal\n\nstreets of this state. A municipality may prohibit the operation of\n\nan electric personal assistive mobility device on public streets\n\nwhere the speed limit is greater than twenty-five (25) miles per\n\nhour but, except for enforcement of the provisions of subsection C\n\nof this section, may not otherwise restrict the operation of an\n\nelectric personal assistive mobility device.\n\nC. 1. A person operating an electric personal assistive\n\nmobility device shall:\n\na. not be required to have an Oklahoma driver license to\n\noperate the device,\n\nb. obey all speed limits,\n\nc. yield the right of way to pedestrians and human\n\npowered devices at all times,\n\nd. give an audible signal before overtaking and passing\n\nany pedestrian, and\n\ne. wear or equip the electric personal assistive mobility\n\ndevice with reflectors and a headlight when operating\n\nat night.\n\n2. Failure to comply with any requirement set forth in\n\nsubparagraphs b through e of paragraph 1 of this subsection shall\n\nresult in a warning for the first offense, a fine of Ten Dollars\n\n($10.00) for the second offense, and impoundment of the electric\n\npersonal assistive mobility device for up to thirty (30) days for\n\nsubsequent offenses. Each act of noncompliance shall be considered\n\na separate offense.\n\nD. 1. It shall be unlawful to manufacture, assemble, sell,\n\noffer to sell, or distribute an electric personal assistive mobility\n\ndevice in this state unless the device is accompanied by a warning\n\nnotice. The warning notice shall be substantially similar to the\n\nfollowing: “REDUCE THE RISK OF SERIOUS INJURY AND ONLY USE WHILE\n\nWEARING FULL PROTECTIVE GEAR, WHICH SHALL INCLUDE HELMET, WRIST\n\nGUARDS, ELBOW PADS, AND KNEE PADS”.\n\n2. A person, firm, corporation, or other legal entity that\n\nregularly engages in the business of manufacturing, assembling,\n\nselling, or distributing electric personal assistive mobility\n\ndevices and complies with the requirements of this subsection shall\n\nnot be liable in a civil action for damages for any physical injury\n\nsustained by an operator of an electric personal assistive mobility\n\ndevice as a result of the operator’s failure to wear protective gear\n\nin accordance with the notice required by paragraph 1 of this\n\nsubsection.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"afd5dce915f0371ecd0295c8e1b516a1ad49d8c1e828470516b15aac6478671d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-11-805.1","next":"us-ok/okla.-stat.-tit.-47-47-11-805.4"},"notice":"GroundRules: Original legal text.
