It shall be unlawful for any person to operate a motor\n\nvehicle on any street or highway within this state while using a\n\nhand-held electronic communication device to manually compose, send\n\nor read an electronic text message while the motor vehicle is in\n\nmotion.\n\nB. Any person who violates the provisions of subsection A of\n\nthis section shall, upon conviction, be punished by a fine of not\n\nmore than One Hundred Dollars ($100.00).\n\nC. The Department of Public Safety shall not record or assess\n\npoints for violations of this section on any license holder's\n\ntraffic record maintained by Service Oklahoma.\n\nD. The provisions of subsection A of this section shall not\n\napply if the person is using the cellular telephone or electronic\n\ncommunication device for the sole purpose of communicating with any\n\nof the following regarding an imminent emergency situation:\n\n1. An emergency response operator;\n\n2. A hospital, physician's office or health clinic;\n\n3. A provider of ambulance services;\n\n4. A provider of firefighting services; or\n\n5. A law enforcement agency.\n\nE. Municipalities may enact and municipal police officers may\n\nenforce ordinances prohibiting and penalizing conduct under the\n\nprovisions of this section. The provisions of such ordinances shall\n\nbe the same as provided for in this section; the enforcement\n\nprovisions of those ordinances shall not be more stringent than\n\nthose of this section; and the fine and court costs for municipal\n\nordinance violations shall be the same or a lesser amount as\n\nprovided for in this section.\n\nF. For the purpose of this section:\n\n1. \"Cellular telephone\" means an analog or digital wireless\n\ntelephone authorized by the Federal Communications Commission to\n\noperate in the frequency bandwidth reserved for cellular telephones;\n\n2. \"Compose\", \"send\" or \"read\" with respect to a text message\n\nmeans the manual entry, sending or retrieval of a text message to\n\ncommunicate with any person or device;\n\n3. \"Electronic communication device\" means an electronic device\n\nthat permits the user to manually transmit a communication of\n\nwritten text by means other than through an oral transfer or wire\n\ncommunication. This term does not include:\n\na. a device that is physically or electronically\n\nintegrated into a motor vehicle,\n\nb. a voice-operated global positioning or navigation\n\nsystem that is affixed to a motor vehicle,\n\nc. a hands-free device that allows the user to write,\n\nsend or read a text message without the use of either\n\nhand except to activate, deactivate or initiate a\n\nfeature or function, or\n\nd. an ignition interlock device that has been installed\n\non a motor vehicle; and\n\n4. \"Text message\" includes a text-based message, instant\n\nmessage, electronic message, photo, video or electronic mail.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0b58089dbbb0a10c6bdac7dab934405be4c35e082c46fccd50febf7306c04c0f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-11-901c","next":"us-ok/okla.-stat.-tit.-47-47-11-901e"},"notice":"GroundRules: Original legal text.
