Stat. tit. 47, § 47-11-901e","heading":"Holding or using a hand-held cell phone or","body":"communication device when in a school zone — Exceptions.\n\nA. For the purpose of this section:\n\n1. “Cellular telephone” means an analog or digital wireless\n\ntelephone authorized by the Federal Communications Commission to\n\noperate in the frequency bandwidth reserved for cellular telephones;\n\n2. “Compose”, “send”, or “read” with respect to a text message\n\nmeans the manual entry, sending, or retrieval of a text message to\n\ncommunicate with any person or device;\n\n3. “Electronic communication device” means an electronic device\n\nthat permits the user to manually transmit a communication of\n\nwritten text by means other than through an oral transfer or wire\n\ncommunication. This term does not include:\n\na. a device that is physically or electronically\n\nintegrated into a motor vehicle,\n\nb. a voice-operated global positioning or navigation\n\nsystem that is affixed to a motor vehicle,\n\nc. a hands-free or voice-operated device that allows the\n\nuser to write, send, or read a text message without\n\nthe use of either hand except to activate, deactivate,\n\nor initiate a feature or function,\n\nd. an ignition interlock device that has been installed\n\non a motor vehicle, or\n\ne. amateur radio use or operation; and\n\n4. \"Text message\" includes a text-based message, instant\n\nmessage, electronic message, photo, video, or electronic mail.\n\nB. Where any portion of a road, street, or highway is a\n\nproperly marked school zone, as indicated with appropriate warning\n\nsigns placed in accordance with the latest edition of the Manual on\n\nUniform Traffic Control Devices, and a reduced speed limit is\n\nproperly posted that is in effect during certain times due to the\n\npresence or potential presence of school children, or in a road\n\nconstruction zone, and while a motor vehicle is in motion, it shall\n\nbe unlawful for any person to operate a motor vehicle on any street\n\nor highway within this state while:\n\n1. Using a hand-held electronic communication device or\n\ncellular telephone to manually compose, send, or read an electronic\n\ntext message; or\n\n2. Holding or using a hand-held cellular telephone.\n\nC. Any person who violates the provisions of subsection B of\n\nthis section shall, upon conviction, be punished by a fine of not\n\nmore than One Hundred Dollars ($100.00).\n\nD. The provisions of subsection B of this section shall not\n\napply if the person is using the cellular telephone or electronic\n\ncommunication device:\n\n1. In conjunction with hands-free or voice-operated technology;\n\nor\n\n2. For the sole purpose of communicating with any of the\n\nfollowing regarding an imminent emergency situation:\n\na. an emergency response operator,\n\nb. a hospital, physician’s office, or health clinic,\n\nc. a provider of ambulance services,\n\nd. a provider of firefighting services, or\n\ne. a law enforcement agency.\n\nE. Municipalities may enact and municipal police officers may\n\nenforce ordinances prohibiting and penalizing conduct under the\n\nprovisions of this section. The provisions of such ordinances shall\n\nbe the same as provided for in this section; the enforcement\n\nprovisions of those ordinances shall not be more stringent than\n\nthose of this section; and the total fine and court costs for\n\nmunicipal ordinance violations shall not exceed One Hundred Dollars\n\n($100.00).\n\nF. The Department of Public Safety shall not record or assess\n\npoints for violations of this section on any license holder’s\n\ntraffic record maintained by Service Oklahoma.\n\nG. A law enforcement officer shall not, without the consent of\n\nthe person:\n\n1. Confiscate a cellular telephone or electronic communication\n\ndevice for the purpose of determining compliance with this section;\n\n2. Confiscate a cellular telephone or electronic communication\n\ndevice and retain it as evidence pending trial for a violation of\n\nthis section; or\n\n3. Extract or otherwise download information from a cellular\n\ntelephone or electronic communication device for a violation of this\ne a cellular telephone or electronic communication\n\ndevice for the purpose of determining compliance with this section;\n\n2. Confiscate a cellular telephone or electronic communication\n\ndevice and retain it as evidence pending trial for a violation of\n\nthis section; or\n\n3. Extract or otherwise download information from a cellular\n\ntelephone or electronic communication device for a violation of this\n\nsection unless:\n\na. the law enforcement officer has probable cause to\n\nbelieve that the cellular telephone or electronic\n\ncommunication device has been used in the commission\n\nof a crime,\n\nb. the information is extracted or otherwise downloaded\n\nunder a valid search warrant, or\n\nc. otherwise authorized by law.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f4387376322b2dcff44a4a262f0edb4526788b6e70ec2f9b2e89c2d4ce5a4421","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-11-901d","next":"us-ok/okla.-stat.-tit.-47-47-11-902"},"notice":"GroundRules: Original legal text.
