Stat. tit. 47, § 47-11-902c","heading":"Preemption of legislation pertaining to prosecution of","body":"offenses related to driving under the influence of alcohol or other\n\nintoxicating substances.\n\nA. The State Legislature hereby occupies and preempts the\n\nentire field of legislation in this state touching in any way the\n\nprosecution of offenses relating to driving under the influence of\n\nalcohol or any other intoxicating substance or operating a motor\n\nvehicle while impaired to the complete exclusion of any order,\n\nordinance, local legislation or regulation by any municipality or\n\nother political subdivision of this state.\n\nB. No municipality or other political subdivision shall\n\nprosecute any laws or ordinances relating to the offense of driving\n\nunder the influence of alcohol or any other intoxicating substance\n\nor operating a motor vehicle while impaired. Any existing or future\n\norders, ordinances, local legislation or regulations in violation of\n\nthis section is void and unenforceable.\n\nC. The preemption provisions of this section shall not apply to\n\nprosecutions in municipal criminal courts of record for offenses\n\nrelating to driving under the influence of alcohol or any other\n\nintoxicating substance or operating a motor vehicle while impaired.\n\nNothing in this section shall prohibit a municipality from\n\nestablishing a municipal criminal court of record pursuant to the\n\nprovisions of Section 28-101 of Title 11 of the Oklahoma Statutes.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9356bbc77ca0c793b62aeb6f2c1fb8827ee87525b096a55924ef622b30345c8a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-11-902b","next":"us-ok/okla.-stat.-tit.-47-47-11-902d"},"notice":"GroundRules: Original legal text.
