Any person who is involved in a personal injury accident\n\nwhile driving or operating a motor vehicle within this state and who\n\nis in violation of the provisions of subsection A of Section 11-902\n\nof this title may be charged with a violation of the provisions of\n\nthis subsection as follows:\n\n1. Any person who is convicted of a violation of the provisions\n\nof this subsection shall be deemed guilty of a misdemeanor for the\n\nfirst offense and shall be punished by imprisonment in the county\n\njail for not less than ninety (90) days nor more than one (1) year,\n\nand a fine of not more than Two Thousand Five Hundred Dollars\n\n($2,500.00); and\n\n2. Any person who is convicted of a violation of the provisions\n\nof this subsection after having been previously convicted of a\n\nviolation of this subsection or of Section 11-902 of this title\n\nshall be deemed guilty of a Class B5 felony offense and shall be\n\npunished by imprisonment in the custody of the Department of\n\nCorrections for not less than one (1) year and not more than five\n\n(5) years, and a fine of not more than Five Thousand Dollars\n\n($5,000.00).\n\nB. 1. Any person who causes an accident resulting in great\n\nbodily injury to any person other than himself while driving or\n\noperating a motor vehicle within this state and who is in violation\n\nof the provisions of subsection A of Section 11-902 of this title\n\nmay be charged with a violation of the provisions of this\n\nsubsection. Any person who is convicted of a violation of the\n\nprovisions of this subsection shall be deemed guilty of a Class B1\n\nfelony offense punishable by imprisonment in the custody of the\n\nDepartment of Corrections for not less than four (4) years and not\n\nmore than twenty (20) years, and a fine of not more than Five\n\nThousand Dollars ($5,000.00).\n\n2.
