Stat. tit. 47, § 47-1105Av2","heading":"Program to permit electronic filing, storage and","body":"delivery of certificates of title.\n\nA. On or before July 1, 2023, Service Oklahoma shall implement\n\na program which will permit the electronic filing, storage, and\n\ndelivery of motor vehicle certificates of title and allow a\n\nlienholder to perfect, assign and release a lien on a motor vehicle\n\nin lieu of submission and maintenance of paper documents as\n\notherwise provided in the provisions of Section 1101 et seq. of this\n\ntitle. Service Oklahoma may:\n\n1. Enter into a competitive contract with a qualified third-\n\nparty service provider (System Developer), subject to the provisions\n\nof the Oklahoma Central Purchasing Act, Section 85.1 et seq. of\n\nTitle 74 of the Oklahoma Statutes;\n\n2. Act as the service provider; or\n\n3. Authorize proprietary provider systems by Oklahoma financial\n\ninstitutions,\n\nto provide necessary hardware, software and services facilitating\n\nthe interconnection between licensed operators and electronic title\n\nservice providers described in subsection B of this section for a\n\ncertificate of title and for filing or releasing a lien pursuant to\n\nthe procedures prescribed by Service Oklahoma. The provisions of\n\nthis section shall apply to certificates of title issued and liens\n\nfiled after June 30, 2022. Service Oklahoma shall promulgate rules\n\nto implement the provisions of this section.\n\nB. The program authorized under subsection A of this section\n\nshall include, but not be limited to, procedures:\n\n1. For the delivery of a certificate of title, on a paper\n\ndocument or in an electronic format, to the secured party having the\n\nprimary perfected security interest in a vehicle in lieu of delivery\n\nto the record owner, notwithstanding the provisions of Section 1101\n\net seq. of this title. When there is no security interest, lien, or\n\nother encumbrance on the vehicle, delivery of a certificate of\n\ntitle, on a paper document or in an electronic format, shall be made\n\nto the record owner. Provided, when electronic transmission of\n\nliens and lien satisfactions is used, a certificate of title need\n\nnot be issued or printed until the last lien is satisfied and a\n\nclear certificate of title is issued to the owner of the vehicle at\n\ntheir request;\n\n2. Establishing qualifications for third-party electronic title\n\nservice providers offering electronic lien services. The vendor\n\nselected in subsection A of this section shall not be considered an\n\nelectronic title service provider and shall not operate or own an\n\nelectronic title service provider;\n\n3. Establishing reasonable fees, if necessary, to be charged by\n\nservice providers or contractors for the establishment, maintenance\n\nand operation of the electronic lien title program;\n\n4. Providing access to the electronic certificate of title\n\nrecords including liens on record, for licensed motor vehicle\n\ndealers and lienholders who participate in the program\n\nnotwithstanding the provisions of Section 1109 of this title;\n\n5. Allowing licensed operators to participate in the electronic\n\nlien title program. Participating licensed operators shall receive\n\nall fees provided by the Oklahoma Vehicle License and Registration\n\nAct unless otherwise provided in Section 1132A of this title; and\n\n6. For the acceptance and use of electronic or digital\n\nsignatures.\n\nC. As used in this section and Section 1101 et seq. of this\n\ntitle:\n\n1. \"Deliver\" or \"delivery\" means, with respect to a certificate\n\nof title or lien, either the physical delivery of a paper document\n\nor the electronic delivery of a document in an electronic format;\n\n2. \"Electronic format\" means an electronic or digital format or\n\nmedium of any document, record or other information; and\n\n3. \"Possess\" or \"possession\" means, with respect to a\n\ncertificate of title or lien, to hold or otherwise exercise control\n\nover a document which is in either a physical or electronic format.\n\nD. Any documents created, stored or delivered under the\nnt in an electronic format;\n\n2. \"Electronic format\" means an electronic or digital format or\n\nmedium of any document, record or other information; and\n\n3. \"Possess\" or \"possession\" means, with respect to a\n\ncertificate of title or lien, to hold or otherwise exercise control\n\nover a document which is in either a physical or electronic format.\n\nD. Any documents created, stored or delivered under the\n\nelectronic lien title program as provided in this section shall be\n\npresumed valid including any signatures which are generated\n\nelectronically or contained on a scanned copy. A certified copy of\n\nService Oklahoma's electronic record of a motor vehicle certificate\n\nof title or lien is admissible in any civil, criminal, or\n\nadministrative proceeding in this state as evidence of the existence\n\nand contents of the certificate of title or lien.\n\nE. The Tax Commission is authorized to expend funds necessary\n\nfor the implementation of the program provided in subsection A of\n\nthis section from available monies in the Oklahoma Tax Commission\n\nand Office of Management and Enterprise Services Joint Computer\n\nEnhancement Fund created pursuant to Section 265 of Title 68 of the\n\nOklahoma Statutes.\n\nF. In the development of the program provided in subsection A\n\nof this section, the Oklahoma Tax Commission shall consult\n\ninterested parties including, but not limited to, representatives of\n\nthe Oklahoma Automobile Dealers Association, the Oklahoma Bankers\n\nAssociation, the Credit Union Association of Oklahoma and the Tag\n\nAgent Coalition.\n\nG. All documents submitted electronically pursuant to the\n\nprovisions of subsection A of this section shall require electronic\n\nverification in lieu of notarization.\n\nH. All documents submitted pursuant to the provisions of this\n\nsection shall be retained pursuant to the provision of subsection A\n\nof this section.\n\nI.
