All information contained in certificates of title,\n\napplications therefor, vehicle registration records, records related\n\nto boats and motors, and computer data files is hereby declared to\n\nbe confidential information and shall not be copied by anyone or\n\ndisclosed to anyone other than employees of Service Oklahoma or the\n\nCorporation Commission in the regular course of their employment,\n\nexcept as provided in subsection B of this section. As used in this\n\nsection, “personal information” means information that identifies an\n\nindividual including name, address (excluding the five-digit ZIP\n\ncode) and telephone number, but does not include information on\n\nvehicular accidents, driving violations and driver’s status.\n\nB. Personal information referred to in subsection A of this\n\nsection shall be disclosed for use in connection with matters of\n\nmotor vehicle or driver safety and theft, motor vehicle emissions,\n\nmotor vehicle product alterations, recalls or advisories, and\n\nremoval of non-owner records from the original owner records of\n\nmotor vehicle manufacturers to carry out the purpose of Titles I and\n\nIV of the Anti Car Theft Act of 1992, the Automobile Information\n\nDisclosure Act (15 U.S.C., Section 1231 et seq.), the Clean Air Act\n\n(42 U.S.C., Section 7401 et seq.) and Chapters 301, 305 and 321-331\n\nof Title 49 of the United States Code and may be disclosed as\n\nfollows:\n\n1. For use by any governmental agency, including but not\n\nlimited to any court or law enforcement agency, in carrying out its\n\nfunctions, or any private person or entity acting on behalf of a\n\nfederal, state or local governmental agency in carrying out its\n\nfunctions. Information relating to motor vehicle insurance,\n\nincluding the insurer and insurance policy numbers, may be released\n\nto law enforcement officers investigating an accident pursuant to\n\nthe provisions of Section 10-104 of this title;\n\n2. For use by any motor vehicle manufacturer or an authorized\n\nrepresentative thereof in connection with matters of motor vehicle\n\nor driver safety and theft, motor vehicle emissions, motor vehicle\n\nproduct alterations, recalls or advisories, performance monitoring\n\nof motor vehicles, motor vehicle parts and dealers, motor vehicle\n\nmarket research activities, including survey research, and removal\n\nof non-owner records from the original owner records of motor\n\nvehicle manufacturers. The confidentiality of the information shall\n\nbe protected, as set out above, and used only for the purpose\n\nstated; provided, further, that Service Oklahoma or the Corporation\n\nCommission shall be authorized to review the use of and the measures\n\nemployed to safeguard the information; and provided, further, that\n\nthe manufacturer or representative shall bear the cost incurred by\n\nService Oklahoma or the Corporation Commission in the production of\n\nthe information requested. If the confidentiality provisions, as\n\nset out above, are violated, the provisions of subsection D of\n\nSection 205 of Title 68 of the Oklahoma Statutes shall apply and the\n\nprivilege of obtaining information shall be terminated. Any\n\nmanufacturer or representative violating the provisions of this\n\nparagraph, upon conviction, shall be punishable by a fine not to\n\nexceed Fifty Thousand Dollars ($50,000.00);\n\n3. For use by any person compiling and publishing motor vehicle\n\nstatistics, provided that such statistics do not disclose the names\n\nand addresses of individuals. Such information shall be provided\n\nupon payment of a reasonable fee as determined by Service Oklahoma\n\nor the Corporation Commission;\n\n4. For use by a wrecker or towing service licensed pursuant to\n\nthe provisions of Section 951 et seq. of this title for use in\n\nproviding notice to the owners and secured parties of towed or\n\nimpounded vehicles, upon payment of a fee of One Dollar ($1.00) per\nals. Such information shall be provided\n\nupon payment of a reasonable fee as determined by Service Oklahoma\n\nor the Corporation Commission;\n\n4. For use by a wrecker or towing service licensed pursuant to\n\nthe provisions of Section 951 et seq. of this title for use in\n\nproviding notice to the owners and secured parties of towed or\n\nimpounded vehicles, upon payment of a fee of One Dollar ($1.00) per\n\nvehicle record page to Service Oklahoma, the Corporation Commission\n\nor any licensed operator;\n\n5. For use by a legitimate business or its agents, employees,\n\nor contractors for use in the normal course of business, upon\n\npayment of a fee of One Dollar ($1.00) per vehicle record page to\n\nService Oklahoma, the Corporation Commission or any licensed\n\noperator, but only:\n\na. to verify the accuracy of personal information\n\nsubmitted by the individual to whom the information\n\npertains to the business or its agents, employees, or\n\ncontractors, or\n\nb. to obtain the correct information, if such information\n\nsubmitted by the individual to whom the information\n\npertains to the business is not correct, or is no\n\nlonger correct, but only for the purposes of\n\npreventing fraud by, pursuing legal remedies against,\n\nor recovering on a debt or security interest against\n\nthe individual;\n\n6. For use in connection with any civil, criminal,\n\nadministrative or arbitral proceeding in any federal, state or local\n\ncourt or agency or before any self-regulatory body, including the\n\nservice of process, investigation in anticipation of litigation, and\n\nthe execution or enforcement of judgments and orders, or pursuant to\n\nan order of a federal, state or local court, upon payment of a fee\n\nof One Dollar ($1.00) per vehicle record page to Service Oklahoma,\n\nthe Corporation Commission or any licensed operator;\n\n7. For use by any insurer or insurance support organization, or\n\nby a self-insured entity, or its agents, employees, or contractors,\n\nin connection with claims investigation activities, anti-fraud\n\nactivities, rating or underwriting, upon payment of a fee of One\n\nDollar ($1.00) per vehicle record page to Service Oklahoma, the\n\nCorporation Commission or any licensed operator;\n\n8. For use by any licensed private investigative agency or\n\nlicensed security service for any purpose permitted under this\n\nsubsection, upon payment of a fee of One Dollar ($1.00) per vehicle\n\nrecord page to Service Oklahoma, the Corporation Commission or any\n\nlicensed operator;\n\n9. For use by a requester, upon payment of a fee of One Dollar\n\n($1.00) per vehicle record page to Service Oklahoma, the Corporation\n\nCommission or any licensed operator, if the requester demonstrates\n\nthat it has obtained the written consent of the individual to whom\n\nthe information pertains;\n\n10. For use in connection with the operation of private toll\n\ntransportation facilities; or\n\n11. For furnishing the name and address of all commercial\n\nentities who have current registrations of any particular model of\n\nvehicle; provided, this exception shall not allow the release of\n\npersonal information pursuant to the provisions of the Driver’s\n\nPrivacy Protection Act, 18 U.S.C., Sections 2721 through 2725.\n\nService Oklahoma shall collect a reasonable fee to recover the\n\ncosts of providing the data. As used in this section, the term\n\n“vehicle record page” means a computer-generated printout of the\n\nmotor vehicle inquiry screen. Information provided on the motor\n\nvehicle inquiry screen printout shall include the current vehicle\n\nowner name and address, vehicle make, model and year, identifying\n\nnumbers for the vehicle license plate, certificate of title and\n\nvehicle identification number, relevant dates relating to the\n\nvehicle registration and certificate of title, lienholder\n\ninformation and lien status.\n\nC. In addition to the information provided on the vehicle\n\nrecord page, Service Oklahoma or the Corporation Commission may,\name and address, vehicle make, model and year, identifying\n\nnumbers for the vehicle license plate, certificate of title and\n\nvehicle identification number, relevant dates relating to the\n\nvehicle registration and certificate of title, lienholder\n\ninformation and lien status.\n\nC. In addition to the information provided on the vehicle\n\nrecord page, Service Oklahoma or the Corporation Commission may,\n\nupon written request, release to any requester authorized by the\n\nprovisions of this section to obtain individual motor vehicle\n\ninformation, corresponding copies of vehicle certificates of title,\n\napplications therefor, vehicle registration records and computer\n\ndata files.\n\nThere shall be an informational search and retrieval fee of Five\n\nDollars ($5.00) per vehicle computer record search. If Service\n\nOklahoma or the Corporation Commission performs a manual search, the\n\nfee shall be Seven Dollars and fifty cents ($7.50) per vehicle.\n\nService Oklahoma is authorized to promulgate rules whereby licensed\n\noperators, when requesting such documentation in the performance of\n\ntheir duties, are exempt from this retrieval fee. Certified copies\n\nof vehicle certificates of title and applications therefor shall be\n\nincluded within the informational search and retrieval by Service\n\nOklahoma or the Corporation Commission for a fee of Ten Dollars\n\n($10.00). Such duly certified copies may be received in evidence\n\nwith the same effect as the original when the original is not in the\n\npossession or under the control of the party desiring to use the\n\nsame.\n\nD. Requesters authorized by this section to receive information\n\nshall submit to Service Oklahoma, the Corporation Commission or any\n\nlicensed operator an affidavit supported by such documentation as\n\nService Oklahoma or the Corporation Commission may require, on a\n\nform prescribed by Service Oklahoma or the Corporation Commission\n\ncertifying that the information is requested for a lawful and\n\nlegitimate purpose and will not be further disseminated.\n\nE. Notwithstanding the foregoing, Service Oklahoma or the\n\nCorporation Commission may allow the release of information from its\n\nmotor vehicle records upon magnetic tape consisting only of the\n\nfollowing information:\n\n1. The date of the certificate of title;\n\n2. The certificate of title number;\n\n3. The type of title issued for the vehicle;\n\n4. The odometer reading from the certificate of title;\n\n5. The year in which the vehicle was manufactured;\n\n6. The vehicle identification number for the vehicle;\n\n7. The make of the vehicle; and\n\n8. The location in which the vehicle is registered.\n\nService Oklahoma or the Corporation Commission shall allow the\n\nrelease of such information upon payment of a reasonable fee to be\n\ndetermined by Service Oklahoma or the Corporation Commission. The\n\ninformation released as authorized by this subsection may only be\n\nused for purposes of detecting odometer rollback or odometer\n\ntampering, for determining the issuance in this state or any other\n\nstate of salvage or rebuilt titles for vehicles or for determining\n\nwhether a vehicle has been reported stolen in this state or any\n\nother state.\n\nF. Notwithstanding the provisions of this section or of Section\n\n205 of Title 68 of the Oklahoma Statutes, Service Oklahoma or the\n\nCorporation Commission may inform a secured party that taxes and\n\nfees are delinquent with respect to a vehicle upon which the secured\n\nparty has a perfected lien.\n\nG. Fees received by a licensed operator pursuant to the\n\nprovisions of this section shall not be included in the maximum sum\n\nthat may be retained by licensed operators as compensation pursuant\n\nto the provisions of Section 1143 of this title.\n\nH. All funds collected by the Tax Commission pursuant to the\n\nprovisions of this section shall be deposited in the Oklahoma Tax\n\nCommission Revolving Fund. Beginning January 1, 2023, all funds\nor pursuant to the\n\nprovisions of this section shall not be included in the maximum sum\n\nthat may be retained by licensed operators as compensation pursuant\n\nto the provisions of Section 1143 of this title.\n\nH. All funds collected by the Tax Commission pursuant to the\n\nprovisions of this section shall be deposited in the Oklahoma Tax\n\nCommission Revolving Fund. Beginning January 1, 2023, all funds\n\ncollected by Service Oklahoma pursuant to the provisions of this\n\nsection shall be deposited in the Service Oklahoma Revolving Fund.\n\nAll funds collected by the Corporation Commission pursuant to the\n\nprovisions of this section shall be apportioned as provided in\n\nsubsection C of Section 1161 of this title.\n\nI. It is further provided that the provisions of this section\n\nshall be strictly interpreted and shall not be construed as\n\npermitting the disclosure of any other information contained in the\n\nfiles and records of Service Oklahoma or the Corporation Commission.\n\nJ. It shall be unlawful for any person to commit any of the\n\nfollowing acts:\n\n1. To knowingly obtain or disclose personal information from a\n\nmotor vehicle record for any use not expressly permitted by this\n\nsection; or\n\n2. To make false representation to obtain any personal\n\ninformation from an individual’s motor vehicle record.\n\nAny violation of the provisions of this section shall constitute\n\na misdemeanor and shall be punishable by the imposition of a fine\n\nnot exceeding One Thousand Dollars ($1,000.00), or by imprisonment\n\nin the county jail for a term not exceeding one (1) year, or by both\n\nsuch fine and imprisonment. Where applicable, a person convicted of\n\na violation of the provisions of this section shall be removed or\n\ndismissed from office or state employment. No liability whatsoever,\n\ncivil or criminal, shall attach to any member or employee of Service\n\nOklahoma or the Corporation Commission for any error or omission in\n\nthe disclosure of such information.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c2d8b5c6ef9ce037db2d91866eb252c0a7410d0f1fc21732f8295dff65f78ef0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-1108","next":"us-ok/okla.-stat.-tit.-47-47-1110"},"notice":"GroundRules: Original legal text.
