Unless otherwise provided by law, any person purchasing a\n\nnew or used manufactured home or owning a manufactured home which\n\nhas not been registered in this state shall register such\n\nmanufactured home pursuant to the provisions of subsection B of this\n\nsection and obtain a certificate of title as provided in Section\n\n1105 of this title.\n\nB. The application for registration and certificate of title\n\nshall be made to Service Oklahoma or to a licensed operator. Such\n\napplication shall be accompanied by the registration fees required\n\nby Section 1135 of this title and any penalties thereon. The\n\napplication for registration and certificate of title shall include:\n\n1. The name of the owner of the manufactured home;\n\n2. The serial number or identification number of the\n\nmanufactured home;\n\n3. A legal description or address of the location;\n\n4. The actual retail selling price of the manufactured home\n\nexcluding Oklahoma taxes; and\n\n5. Any other information which Service Oklahoma deems to be\n\nnecessary.\n\nThe application for registration shall also include the school\n\ndistrict in which the manufactured home is located or is to be\n\nlocated.\n\nUpon the filing of an application for registration and\n\ncertificate of title, the payment of fees as required by Section\n\n1133 of this title, the excise tax as provided for in Section 2104.3\n\nof Title 68 of the Oklahoma Statutes and the furnishing of proof\n\nsatisfactory to Service Oklahoma or a licensed operator that all ad\n\nvalorem taxes have been paid, Service Oklahoma or a licensed\n\noperator shall assign the manufactured home a distinctive number and\n\nshall issue to the owner of the manufactured home a certificate of\n\ntitle, a manufactured home registration receipt, Manufactured Home\n\nRegistration Decal, a vehicle registration decal and an excise tax\n\nreceipt. The certificate of title number shall be recorded in the\n\ncomputer data system required by Section 1113 of this title in order\n\nto collect and store information concerning the subsequent ad\n\nvalorem tax payments for such manufactured home. The receipts and\n\nManufactured Home Registration Decal shall be permanently attached\n\nto the title by Service Oklahoma or a licensed operator. An excise\n\ntax receipt so attached shall constitute evidence of payment of the\n\nexcise tax required by the provisions of Section 2104.3 of Title 68\n\nof the Oklahoma Statutes. Thereafter, the owner of a manufactured\n\nhome shall be assessed the ad valorem tax as provided in Section\n\n2801 et seq. of Title 68 of the Oklahoma Statutes. A duplicate\n\nManufactured Home Registration Decal shall be affixed inside the\n\nwindow nearest the front door of the manufactured home before it is\n\nmoved upon any public roadway.\n\nC. If an applicant has satisfactorily shown to Service Oklahoma\n\nor to a licensed operator that the applicant owns the manufactured\n\nhome sought to be registered, but is unable to produce the\n\ndocumentary evidence of title, Service Oklahoma or a licensed\n\noperator may issue a manufactured home registration receipt,\n\nManufactured Home Registration Decal, vehicle registration decal and\n\nexcise tax receipt to the applicant. In such instances, Service\n\nOklahoma or a licensed operator shall indicate on the receipt given\n\nthe applicant the reason for not issuing a certificate of title. It\n\nshall be the duty of the applicant to immediately take all necessary\n\nsteps to obtain an Oklahoma certificate of title. It shall be\n\nunlawful for such applicant to sell the manufactured home until such\n\ntitle has been obtained by the applicant. After receiving a\n\ncertificate of title, the applicant shall then take such title,\n\nregistration and excise tax receipts and Manufactured Home\n\nRegistration Decal to Service Oklahoma or a licensed operator for\n\npermanent attachment of the receipts to the title.\n\nD. The Department of Public Safety shall issue a permit\n\nimmediately to the holder of a perfected security interest or\nby the applicant. After receiving a\n\ncertificate of title, the applicant shall then take such title,\n\nregistration and excise tax receipts and Manufactured Home\n\nRegistration Decal to Service Oklahoma or a licensed operator for\n\npermanent attachment of the receipts to the title.\n\nD. The Department of Public Safety shall issue a permit\n\nimmediately to the holder of a perfected security interest or\n\nlicensed representative thereof, if the holder or representative is\n\nbonded by the state, to move the manufactured home to a secure\n\nlocation with a repossession affidavit. However, all excise taxes\n\nand ad valorem taxes due on such a manufactured home shall be\n\nrequired to be paid within thirty (30) days of the issuance of the\n\npermit. A certificate of title for a manufactured home shall not be\n\nissued pursuant to a repossession prior to the furnishing of proof\n\nsatisfactory to Service Oklahoma or a licensed operator that all ad\n\nvalorem taxes due have been paid.\n\nE. The Department shall issue a permit immediately to a\n\nlicensed manufactured home dealer to move a trade-in to a secure\n\nlocation with a trade-in affidavit. However, all excise taxes and\n\nad valorem taxes due on such a manufactured home trade-in shall be\n\nrequired to be paid within thirty (30) days of the issuance of the\n\npermit. A certificate of title for a manufactured home trade-in\n\nshall not be issued prior to the furnishing of proof satisfactory to\n\nService Oklahoma or a licensed operator that all ad valorem taxes\n\ndue have been paid.
