Service Oklahoma or a private vendor with whom Service\n\nOklahoma has contracted is authorized to design and issue special\n\nlicense plates to any person that applies to Service Oklahoma or a\n\nprivate vendor for the creation of a special license plate and meets\n\nthe minimum standards and qualifications specified in this section.\n\nB. If the following standards and guidelines are satisfied,\n\nService Oklahoma shall authorize the issuance of a special license\n\nplate to the person making application for the special license\n\nplate:\n\n1. The license plate is to:\n\na. show membership in or affiliation with an\n\norganization, or\n\nb. demonstrate support for an organization, group or\n\ncause;\n\n2. The license plate does not advertise or endorse a product,\n\nbrand or service that is provided for sale;\n\n3. The license plate does not promote any philosophy based on\n\nprejudice or that is contrary to state civil rights laws; and\n\n4. Two hundred prepaid applications for the special license\n\nplate are received by Service Oklahoma or a private vendor.\n\nC. The fee for special license plates shall be determined in\n\naccordance with Section 1135.9 of this title. If the special\n\nlicense plate does not provide financial assistance the fee shall be\n\nno less than Fifteen Dollars ($15.00) per year of renewal and shall\n\nbe in addition to all other registration fees provided by the\n\nOklahoma Vehicle License and Registration Act. Unless otherwise\n\nprovided in this section, until December 31, 2022, Fifteen Dollars\n\n($15.00) of the fee shall be apportioned as follows: Eight Dollars\n\n($8.00) of the special license plate fee shall be deposited in the\n\nOklahoma Tax Commission Reimbursement Fund to be used for the\n\nadministration of the Oklahoma Vehicle License and Registration Act\n\nand the remaining amounts of the special license plate fee shall be\n\napportioned as provided in Section 1104 of this title. Beginning\n\nJanuary 1, 2023, Eight Dollars ($8.00) of the special license plate\n\nfee shall be deposited by Service Oklahoma in the Service Oklahoma\n\nReimbursement Fund to be used for the administration of the Oklahoma\n\nVehicle License and Registration Act and the remaining amounts of\n\nthe special license plate fee shall be apportioned by Service\n\nOklahoma as provided in Section 1104 of this title.\n\nD. For special license plates that provide financial assistance\n\ncreated pursuant to the provisions of this section, Service Oklahoma\n\nshall be authorized to enter into a licensing agreement with an\n\norganization for any licensing fees that may be required to use the\n\norganization’s logo or design.\n\nE. The fee for special license plates that provide financial\n\nassistance shall be determined in accordance with Section 1135.9 of\n\nthis title. Provided, the fee shall be no less than Thirty-five\n\nDollars ($35.00) and shall be in addition to all other registration\n\nfees provided by the Oklahoma Vehicle License and Registration Act.\n\nThirty-five Dollars ($35.00) per year of renewal of the fee shall be\n\napportioned by Service Oklahoma as follows:\n\n1. a. Twenty Dollars ($20.00) of the fee shall be\n\napportioned to the License Plate Special Program\n\nAssistance Revolving Fund created in Section 1135.8 of\n\nthis title to be used in the manner detailed in the\n\napplication for the special license plate, except as\n\nprovided in subparagraph b of this paragraph.\n\nb. If Service Oklahoma has entered into a licensing\n\nagreement with an organization for the use of its\n\ndesign or logo pursuant to Chapter 74 of this title,\n\nan amount to be determined in the licensing agreement,\n\nbut not to exceed Twenty Dollars ($20.00) per license\n\nplate issued, shall be transferred monthly to that\n\norganization as payment of licensing fees and no fee\n\nshall be apportioned to the License Plate Special\n\nProgram Assistance Revolving Fund;\nnt with an organization for the use of its\n\ndesign or logo pursuant to Chapter 74 of this title,\n\nan amount to be determined in the licensing agreement,\n\nbut not to exceed Twenty Dollars ($20.00) per license\n\nplate issued, shall be transferred monthly to that\n\norganization as payment of licensing fees and no fee\n\nshall be apportioned to the License Plate Special\n\nProgram Assistance Revolving Fund;\n\n2. Until December 31, 2022, Eight Dollars ($8.00) of the fee\n\nshall be deposited in the Oklahoma Tax Commission Reimbursement Fund\n\nto be used for the administration of the Oklahoma Vehicle License\n\nand Registration Act. Beginning January 1, 2023, Eight Dollars\n\n($8.00) of the fee shall be deposited by Service Oklahoma in the\n\nService Oklahoma Reimbursement Fund to be used for the\n\nadministration of the Oklahoma Vehicle License and Registration Act;\n\nand\n\n3. Any remaining amounts of the fee shall be apportioned as\n\nprovided in Section 1104 of this title.\n\nF. Except as otherwise provided in subsection D and\n\nsubparagraph b of paragraph 1 of subsection E of this section, if a\n\nperson applies for a special license plate that provides financial\n\nassistance, the application shall designate a state agency to be\n\nresponsible for expending the funds generated by the special license\n\nplate and the application shall designate a specific public purpose\n\nfor which the funds are to be used. The application shall include\n\nan acknowledgment from the designated state agency of their\n\nagreement with acceptance of the designated funds.\n\nG. Special license plates shall not be transferred to any other\n\nperson but shall be removed from the vehicle upon transfer of\n\nownership and retained. The special license plate may then be used\n\non another vehicle but only after such other vehicle has been\n\nregistered for the current year.\n\nSpecial license plates shall be renewed each year by Service\n\nOklahoma or a licensed operator, unless authorized by Service\n\nOklahoma to be renewed for a period greater than one (1) year.\n\nService Oklahoma shall notify all persons issued special license\n\nplates of the renewal procedures prior to the expiration of the\n\nspecial license plate. The notice shall contain all necessary\n\ninformation and shall contain instructions for the renewal procedure\n\nupon presentation to a t licensed operator or Service Oklahoma. The\n\nlicense plates shall be issued on a staggered system.\n\nOn and after January 1, 2022, if a special license plate is\n\nissued pursuant to this section, any registration fee required for\n\nsuch plate and the fee required pursuant to Section 1132 of this\n\ntitle shall be remitted at the same time and subject to a single\n\nregistration period. Service Oklahoma shall determine, by rule, a\n\nmethod for making required fee and registration period adjustments\n\nif a special license plate is obtained during a twelve-month period\n\nfor which registration has already been remitted pursuant to Section\n\n1132 of this title. The combination of fees in a single remittance\n\nshall not alter the apportionment otherwise provided for in this\n\nsection.\n\nService Oklahoma is hereby directed to develop and implement a\n\nsystem whereby licensed operators are permitted to accept\n\napplications for special license plates authorized under this\n\nsection. The licensed operator shall confirm the applicant’s\n\neligibility, if applicable, collect and deposit any amount\n\nspecifically authorized by law, accept and process the necessary\n\ninformation directly into such system and generate a receipt\n\naccordingly. For performance of these duties, licensed operators\n\nshall retain the fee provided in Section 1141.1 of this title for\n\nregistration of a motor vehicle. The licensed operator fees for\n\nacceptance of applications and renewals shall be paid out of the\n\nOklahoma Tax Commission Reimbursement Fund. Beginning January 1,\n\n2023, the licensed operator fees for acceptance of applications and\nt\n\naccordingly. For performance of these duties, licensed operators\n\nshall retain the fee provided in Section 1141.1 of this title for\n\nregistration of a motor vehicle. The licensed operator fees for\n\nacceptance of applications and renewals shall be paid out of the\n\nOklahoma Tax Commission Reimbursement Fund. Beginning January 1,\n\n2023, the licensed operator fees for acceptance of applications and\n\nrenewals shall be paid out of the Service Oklahoma Reimbursement\n\nFund.\n\nH. All special plates issued by Service Oklahoma prior to\n\nNovember 1, 2005, shall not be subject to the requirements and\n\nqualifications outlined in this section.\n\nI.
