Service Oklahoma is authorized to enter into a contract with\n\na private vendor experienced in the marketing and sale of:\n\n1. Personalized license plates authorized under Section 1135.4\n\nof Title 47 of the Oklahoma Statutes; and\n\n2. Special license plates authorized under Sections 1135.3,\n\nll35.5 and 1135.7 of Title 47 of the Oklahoma Statutes.\n\nB. 1. Service Oklahoma shall establish by rule administrative\n\nfees for license plates issued and renewed under the provisions of\n\nsubsection A of this section. The administrative fees authorized by\n\nthis paragraph shall be reasonable but not less than the amounts\n\nnecessary for Service Oklahoma to recover costs to Service Oklahoma\n\nassociated with the:\n\na. awarding of the contract authorized by this section,\n\nb. implementation and enforcement of such contract, and\n\nc. direct and indirect administrative costs associated\n\nwith administering the provisions of this section.\n\n2. The fees authorized by this subsection shall be in addition\n\nto all other registration fees provided by the Oklahoma Vehicle\n\nLicense and Registration Act, including the fees required by\n\nSections 1135.3, 1135.4, ll35.5 and 1135.7 of Title 47 of the\n\nOklahoma Statutes.\n\nC. The contracted amount payable to a private vendor related to\n\nthe marketing and sale of special license plates shall only be\n\npayable from amounts derived from administrative fees associated\n\nwith the issuance and renewal of such personalized and special\n\nlicense plates.\n\nD. 1. Service Oklahoma may approve additional designs and\n\ncolor combinations for personalized and special license plates\n\nauthorized under the provisions of Title 47 of the Oklahoma\n\nStatutes, including for special license plates that may be\n\npersonalized, that may be marketed and sold by a private vendor\n\nunder a contract entered into under the provisions of this section.\n\nEach approved license plate design and color combination shall\n\nremain the property of Service Oklahoma.\n\n2. This subsection shall not be interpreted to authorize:\n\na. Service Oklahoma to approve a design or color\n\ncombination for a specialty license plate, or\n\nb. the private vendor to market or sell a special license\n\nplate with a design or color combination,\n\nthat is inconsistent with the design or color combination specified\n\nfor the license plate in the special license plate’s authorizing\n\nstatute.\n\nE. Service Oklahoma shall not:\n\n1. Restrict the background color, color combinations or color\n\nalphanumeric license plate numbers of a special license plate,\n\nexcept as determined by the Department of Public Safety as necessary\n\nfor law enforcement purposes;\n\n2. Restrict the private vendor from conducting reasonable\n\nevents or auctions;\n\n3. Restrict the right of the private vendor to offer a variety\n\nof plate categories with both personalized and nonpersonalized\n\npatterns; or\n\n4. Unreasonably disapprove or limit the ability for the private\n\nvendor to offer plate terms that exceed one (1) year.\n\nF. Service Oklahoma may cancel a license plate or require the\n\ndiscontinuation or redesign of a license plate design or color\n\ncombination that is marketed and sold by a private vendor under\n\ncontract at any time if Service Oklahoma determines that the\n\ncancellation or discontinuation is in the best interest of the state\n\nor the motoring public.\n\nG. To the extent fees collected under the provisions of this\n\nsection are in excess of the total amounts provided in subparagraphs\n\na, b and c of paragraph 1 of subsection B of this section and other\n\napportionment provisions for personalized or specialized license\n\nplates, the excess amount shall be deposited by Service Oklahoma to\n\nthe credit of the General Revenue Fund.\n\nH. 1. A contract entered into with a private vendor under the\n\nprovisions of this section shall provide for Service Oklahoma to\n\nrecover all costs incurred by Service Oklahoma in implementing the\nB of this section and other\n\napportionment provisions for personalized or specialized license\n\nplates, the excess amount shall be deposited by Service Oklahoma to\n\nthe credit of the General Revenue Fund.\n\nH. 1. A contract entered into with a private vendor under the\n\nprovisions of this section shall provide for Service Oklahoma to\n\nrecover all costs incurred by Service Oklahoma in implementing the\n\nprovisions of this section. Under the provisions of the contract,\n\nService Oklahoma may require the private vendor to reimburse Service\n\nOklahoma in advance for:\n\na. not more than one-half (1/2) of Service Oklahoma’s\n\nanticipated costs in initiating the contract, and\n\nb. Service Oklahoma’s anticipated costs in coordinating\n\nthe introduction of a new special license plate.\n\n2. The initial term of contract entered into under the\n\nprovisions of this section shall be no less than five (5) years in\n\nduration. Such contract may provide for additional terms at least\n\nequal in length to the initial term of the contract.\n\nI. As applied to contracts entered under the provisions of this\n\nsection, Service Oklahoma shall not:\n\n1. Unreasonably disapprove or limit any aspect of a private\n\nvendor’s marketing and sales plan; or\n\n2. Unreasonably interfere with the selection, assignment or\n\nmanagement by the private vendor of the private vendor’s employees,\n\nagents or subcontractors.\n\nJ. A private vendor shall not market and sell license plates\n\nthat compete directly for sales with other special license plates\n\nissued under the provisions of Title 47 of the Oklahoma Statutes,\n\nunless Service Oklahoma and the agency or organization associated\n\nwith the special license plate authorizes such marketing and sale.\n\nK. Service Oklahoma is hereby directed to develop and implement\n\na system whereby licensed operators are permitted to accept\n\napplications for special license plates authorized under this\n\nsection. The licensed operator shall collect and deposit any amount\n\nspecifically authorized by law, accept and process the necessary\n\ninformation directly into such system, and generate a receipt\n\naccordingly. For performance of these duties, licensed operators\n\nshall retain the fee provided in Section 1141.1 of Title 47 of the\n\nOklahoma Statutes for each year of registration of a motor vehicle.\n\nThe licensed operator fees for acceptance of applications and\n\nrenewals shall be paid out of the Service Oklahoma Reimbursement\n\nFund.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"468fa8ddd5a138bc942f6a7d066bdef3cc97732728a41711ce8c4f174d225045","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-1135.8","next":"us-ok/okla.-stat.-tit.-47-47-1136.2"},"notice":"GroundRules: Original legal text.
