Stat. tit. 47, § 47-1167","heading":"Rules to establish fees, fines and penalties -","body":"Adjudication of enforcement actions - Apportionment of revenue -\n\nRevolving funds.\n\nA. The Corporation Commission is hereby authorized to\n\npromulgate rules pursuant to the Administrative Procedures Act to\n\nestablish the amounts of fees, fines and penalties as set forth in\n\nSection 1166 et seq. of this title. The Corporation Commission\n\nshall notify all interested parties of any proposed rules to be\n\npromulgated as provided herein and shall provide such parties an\n\nopportunity to be heard prior to promulgation.\n\nB. The Corporation Commission shall adjudicate enforcement\n\nactions initiated by Corporation Commission personnel.\n\nC. Revenue derived from all fines and penalties collected or\n\nreceived by the Corporation Commission pursuant to the provisions of\n\nthe Trucking One-Stop Shop Act shall be apportioned as follows:\n\n1. For the period beginning August 23, 2013, the first Three\n\nHundred Thousand Dollars ($300,000.00) collected or received each\n\nfiscal year shall be remitted to the Department of Public Safety for\n\nthe purpose of staffing the port of entry weigh stations to conduct\n\nsafety inspections. The next Five Hundred Fifty Thousand Dollars\n\n($550,000.00) shall be remitted to Service Oklahoma and apportioned\n\nas provided in Section 1104 of this title; and\n\n2. The remaining amount shall be deposited to the Trucking One-\n\nStop Shop Fund created in subsection D of this section.\n\nD. There is hereby created in the State Treasury a revolving\n\nfund for the Corporation Commission to be known and designated as\n\nthe “Trucking One-Stop Shop Fund”. The Trucking One-Stop Shop Fund\n\nshall consist of:\n\n1. All funds apportioned thereto in subsection C of this\n\nsection;\n\n2. Fees collected by the Commission to be retained as a\n\nlicensed operator or other Corporation Commission registration or\n\nmotor fuel fees as allowed by statute or rule; and\n\n3. Any other monies to be utilized for the Trucking One-Stop\n\nShop Act.\n\nThe fund shall be a continuing fund, not subject to fiscal year\n\nlimitations, and shall not be subject to legislative appropriation.\n\nMonies in the Trucking One-Stop Shop Fund shall only be expended for\n\ndirect expenses relating to the Trucking One-Stop Shop Act.\n\nExpenditures from the revolving fund shall be made pursuant to the\n\nlaws of this state. In addition, expenditures from the revolving\n\nfund may be made pursuant to the Oklahoma Central Purchasing Act for\n\nthe purpose of immediately responding to emergency situations,\n\nwithin the Commission’s jurisdiction, having potentially critical\n\nenvironmental or public safety impact. Warrants for expenditures\n\nfrom the fund shall be drawn by the State Treasurer against claims\n\nfiled as prescribed by law with the Director of the Office of\n\nManagement and Enterprise Services for approval and payment.\n\nE. There is hereby created in the State Treasury a revolving\n\nfund for the Department of Transportation to be designated the\n\n“Weigh Station Improvement Revolving Fund”. The fund shall be a\n\ncontinuing fund, not subject to fiscal year limitations, and shall\n\nconsist of all monies deposited thereto. All monies accruing to the\n\ncredit of the fund are hereby appropriated and may be budgeted and\n\nexpended by the Department for the purpose of constructing,\n\nequipping and maintaining facilities to determine the weight of\n\nvehicles traveling on the roads and highways of this state.\n\nExpenditures from the fund shall be made upon warrants issued by the\n\nState Treasurer against claims filed as prescribed by law with the\n\nDirector of the Office of Management and Enterprise Services for\n\napproval and payment.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1e1f12b31a7560c2d905df2cf5454637e7623e83cbc95b4ac6cffd220058e682","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-1166","next":"us-ok/okla.-stat.-tit.-47-47-1168"},"notice":"GroundRules: Original legal text.
