It shall be a misdemeanor, upon conviction, punishable as\n\nprovided in Section 17-101 of this title, for any person:\n\n1. To drive or move, or for the owner to cause or permit to be\n\ndriven or moved on any highway, any vehicle or combination of\n\nvehicles which:\n\na. is known to be in such unsafe condition as to endanger\n\nany person,\n\nb. is known not to contain those parts required by this\n\nchapter,\n\nc. is not at all times equipped with such lamps and other\n\nequipment in proper condition and adjustment as\n\nrequired in this chapter, or\n\nd. is known to be equipped in any manner in violation of\n\nthis chapter;\n\n2. To do any act forbidden under this chapter; or\n\n3. To fail to perform any act required under this chapter.\n\nB. Nothing contained in this chapter shall be construed to\n\nprohibit on any vehicle:\n\n1. Equipment required by the United States Department of\n\nTransportation pursuant to 49 C.F.R., Chapter V; or\n\n2. The use of additional parts and accessories which are not\n\ninconsistent with provisions of this chapter.\n\nC. The provisions of Article II et seq. of this chapter with\n\nrespect to equipment on vehicles shall not apply to implements of\n\nhusbandry, road machinery, road rollers, farm tractors, motorcycles\n\nas defined in Section 12-601 of this title, or vehicles designed to\n\nbe moved solely by animal or human power, except as specifically\n\nmade applicable in this chapter.\n\nD. Any specific requirement of this chapter with respect to\n\nequipment on any vehicle, other than a bicycle, shall not apply if\n\nthe vehicle was lawfully designed and manufactured without such\n\nequipment; provided, the provisions of this chapter shall apply to\n\nany homemade vehicle or any vehicle constructed from a kit or from\n\nplans.\n\nE. Low-speed and medium-speed electrical vehicles which are in\n\ncompliance with the equipment requirements in 49 C.F.R., Section\n\n571.500 shall be deemed to be in compliance with the provisions of\n\nthis chapter.\n\nF. The provisions of this chapter shall not apply to vehicles\n\nregistered in Oklahoma as antique or classic vehicles pursuant to\n\nSections 1105 and 1135.1 of this title and rules promulgated\n\npursuant thereto.\n\nG. The Commissioner of Public Safety may promulgate rules\n\nregarding vehicle equipment and standards for vehicle equipment\n\nrequired to maintain such equipment in safe condition and in\n\ncompliance with this chapter.\n\nH. Any person producing proof within forty-eight (48) hours\n\nthat a condition or equipment for which the person was cited as\n\ndefective, missing, prohibited, improper, unauthorized or otherwise\n\nin violation of this chapter has been remedied by the person shall\n\nbe entitled to dismissal of such charge without assessment of court\n\ncosts.\n\nI. As used in this chapter:\n\n1. \"Lamp\" means an electrical device producing artificial\n\nillumination by use of one or more lights, each light of which\n\nperforms the same function or separate functions as required by this\n\nchapter;\n\n2. \"Lightweight vehicle\" means a motor vehicle that has a\n\nmanufacturer’s gross vehicle weight rating of ten thousand (10,000)\n\npounds or less, other than:\n\na. a vehicle that is being used to transport passengers\n\nfor hire, or\n\nb. a vehicle that is being used to transport hazardous\n\nmaterials of a type or quantity that requires the\n\nvehicle to be marked or placarded under 49 C.F.R.,\n\nSection 177.823;\n\n3. \"Nighttime\" or \"night\" means any time from one-half (1/2)\n\nhour after sunset to one-half (1/2) hour before sunrise; and\n\n4. “Passenger car” means a motor vehicle designed for carrying\n\nten persons, including the driver, or less except a low-speed or\n\nmedium-speed electrical vehicle or motorcycle, as defined in Section\n\n12-601 of this title.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ca111ade41addacbc088b324709f240beddba7596643379ce61b51c361325cde","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-1170","next":"us-ok/okla.-stat.-tit.-47-47-12-101.1"},"notice":"GroundRules: Original legal text.
