As used in this section:\n\n1. \"Airbag\" means an inflatable restraint device for vehicle\n\noccupants that is part of a supplemental restraint system in a motor\n\nvehicle;\n\n2. \"Counterfeit supplemental restraint system component\" means\n\na replacement supplemental restraint system component that displays\n\na mark identical or substantially similar to the genuine mark of a\n\nmotor vehicle manufacturer or supplier of parts to a motor vehicle\n\nmanufacturer without authorization from that manufacturer or\n\nsupplier;\n\n3. \"Nonfunctional airbag\" means a replacement airbag that:\n\na. was previously deployed or damaged,\n\nb. has an electric fault that is detected by the motor\n\nvehicles' diagnostic systems when the installation\n\nprocedure is completed and the motor vehicle is\n\nreturned to the customer who requested the work to be\n\nperformed or when ownership is intended to be\n\ntransferred,\n\nc. includes a part or object, including a supplemental\n\nrestraint system component, installed in a motor\n\nvehicle to mislead the owner or operator of the motor\n\nvehicle into believing that a functional airbag has\n\nbeen installed, or\n\nd. is prohibited in accordance with 49 U.S.C. Section\n\n301209(j) from being sold or leased;\n\n4. \"Supplemental restraint system\" means a passive motor\n\nvehicle occupant crash protection system designed for use in\n\nconjunction with active restraint systems, including, but not\n\nlimited to, seat belt assemblies, as described in 49 CFR 571.208.\n\nSuch term shall include:\n\na. each airbag installed in accordance with the motor\n\nvehicle manufacturer's design, and\n\nb. all components required to ensure that an airbag\n\noperates as designed by the manufacturer in the event\n\nof a crash and in accordance with the federal motor\n\nvehicle safety standards for the specific make, model\n\nand year of the motor vehicle.\n\nB. No person shall knowingly or intentionally manufacture,\n\nimport, distribute, sell, offer for sale, install, or reinstall a\n\ndevice intended to replace a component of a supplemental restraint\n\nsystem if the device is:\n\n1. A counterfeit supplemental restraint system component;\n\n2. A nonfunctional airbag; or\n\n3. Any object in lieu of a supplemental restraint system\n\ncomponent if the object was not designed in accordance with federal\n\nsafety regulations for the make, model, and year of the motor\n\nvehicle in which such device is or will be installed.\n\nC.
