Stat. tit. 47, § 47-14-101","heading":"Scope and effect of chapter – Issuance of annual","body":"overweight permits - Movement of certain vehicles at nighttime and\n\non holidays\n\nA. It is a misdemeanor for any person to drive or move or for\n\nthe owner to cause or knowingly permit to be driven or moved on any\n\nhighway any vehicle or vehicles of a size or weight exceeding the\n\nlimitations stated in this chapter or otherwise in violation of this\n\nchapter, and the maximum size and weight of vehicles herein\n\nspecified shall be lawful throughout this state and local\n\nauthorities shall have no power or authority to alter the\n\nlimitations except as express authority may be granted in this\n\nchapter.\n\nB. The Executive Director of the Department of Transportation\n\nis directed to issue annual overweight permits to:\n\n1. Municipalities and rural fire districts for the\n\ntransportation of firefighting apparatus at no cost to the\n\nmunicipalities or rural fire districts;\n\n2. Owners of implements of husbandry, which includes tractors\n\nthat are temporarily moved upon a highway at no cost to the owner;\n\n3. Retail implement dealers while hauling implements of\n\nhusbandry at no cost to the dealer; and\n\n4. Owners of certain vehicles as provided for in Section 14-\n\n103G of this title.\n\nC. If a vehicle is issued a license pursuant to Section 1134.4\n\nof this title, the license shall also serve as the overweight permit\n\nrequired by this section.\n\nD. All size, weight and load provisions covered by this chapter\n\nshall be subject to the limitations imposed by Title 23, United\n\nStates Code, Section 127, and such other rules and regulations\n\ndeveloped herein. Provided further that any size and weight\n\nprovision authorized by the United States Congress for use on the\n\nNational System of Interstate and Defense Highways, including, but\n\nnot limited to, height, axle weight, gross weight, combinations of\n\nvehicles or load thereon shall be authorized for immediate use on\n\nsuch segments of the National System of Interstate and Defense\n\nHighways and any other highways or portions thereof as designated by\n\nthe Transportation Commission or their duly authorized\n\nrepresentative.\n\nE. All size, weight and load provisions covered by Sections 14-\n\n101 through 14-123 of this title shall be subject to a gross vehicle\n\nweight limit of ninety thousand (90,000) pounds when applied to a\n\nvehicle operating off the National System of Interstate and Defense\n\nHighways unless such vehicle is operating in full compliance with an\n\noverweight permit issued by the Executive Director of the Department\n\nof Transportation.\n\nF. Any vehicle permitted for movement on the highways of this\n\nstate as provided in Section 14-101 et seq. of this title, other\n\nthan a vehicle permitted solely for overweight movement, shall be\n\nmoved only during daylight hours. As used in Section 14-101 et seq.\n\nof this title, \"daylight hours\" shall mean one-half (1/2) hour\n\nbefore sunrise to one-half (1/2) hour after sunset. The Executive\n\nDirector of the Department of Transportation, for good cause and\n\nconsistent with the safe movement of the vehicle, may endorse a\n\npermit for the movement of an oversize vehicle to authorize\n\nnighttime travel under such terms and restrictions as the Executive\n\nDirector of the Department of Transportation may require.\n\nG. 1. Any vehicle permitted for movement on the highways of\n\nthis state as provided in Section 14-101 et seq. of this title shall\n\nnot be moved at any time on the following holidays:\n\na. New Year's Day (January 1),\n\nb. Memorial Day (the last Monday in May),\n\nc. Fourth of July (Independence Day),\n\nd. Labor Day (the first Monday in September),\n\ne. Thanksgiving Day (the fourth Thursday in November),\n\nand\n\nf. Christmas Day (December 25).\n\n2. Any vehicle permitted for movement on the highways of this\n\nstate as provided in Section 14-101 et seq. of this title shall be\n\nallowed to move on the following holidays:\n\na. Martin Luther King, Jr.'s Birthday (the third Monday\n\nin January),\nendence Day),\n\nd. Labor Day (the first Monday in September),\n\ne. Thanksgiving Day (the fourth Thursday in November),\n\nand\n\nf. Christmas Day (December 25).\n\n2. Any vehicle permitted for movement on the highways of this\n\nstate as provided in Section 14-101 et seq. of this title shall be\n\nallowed to move on the following holidays:\n\na. Martin Luther King, Jr.'s Birthday (the third Monday\n\nin January),\n\nb. President's Day, also known as Washington's Birthday\n\n(the third Monday in February), and\n\nc.
