Stat. tit. 47, § 47-14-103G","heading":"Oversize or overweight load vehicle permits - Annual","body":"fleet permits – Permits for movement of oversized portable\n\nbuildings.\n\nA. 1. The Department of Transportation may issue an annual\n\nvehicle permit under the provisions of this subsection to a specific\n\nvehicle, for the movement of oversize or overweight loads that\n\ncannot reasonably be dismantled. Unless otherwise provided by law,\n\npermits issued under this subsection shall be subject to the\n\nconditions described in paragraphs 2 through 8 of this subsection.\n\n2. Oversize or overweight loads operating under an annual\n\nvehicle permit shall not exceed:\n\na. twelve (12) feet in width,\n\nb. fourteen (14) feet in height,\n\nc. one hundred ten (110) feet in length, or\n\nd. one hundred twenty thousand (120,000) pounds gross\n\nweight.\n\n3. Oversize or overweight loads operating under an annual\n\nvehicle permit under this subsection shall not transport a load that\n\nhas more than a twenty-five-foot front overhang, or more than a\n\nthirty-foot rear overhang.\n\n4. The fee for an annual vehicle permit shall be Four Thousand\n\nDollars ($4,000.00) and shall be nonrefundable.\n\n5. The annual vehicle permit shall be issued for one (1)\n\ncalendar year period and shall commence upon the date specified on\n\nthe permit.\n\n6. An annual vehicle permit issued pursuant to this subsection\n\nshall be nontransferable between permittees.\n\n7. The permitted vehicle or vehicle combination shall be\n\nregistered in accordance with the provisions of Chapter 14 of this\n\ntitle for maximum weight.\n\n8. An annual vehicle permit issued pursuant to this subsection\n\nmay be transferred from one vehicle to another vehicle in the fleet\n\nof the permittee provided:\n\na. the permitted vehicle is destroyed or otherwise\n\nbecomes permanently inoperable to the extent that the\n\nvehicle will no longer be utilized, and the permittee\n\npresents proof to the Department of Transportation\n\nthat the negotiable certificate of title or other\n\nqualifying documentation has been surrendered to the\n\nDepartment of Transportation, or\n\nb. the certificate of title to the permitted vehicle is\n\ntransferred to someone other than the permittee, and\n\nthe permittee presents proof to the Department of\n\nTransportation that the negotiable certificate of\n\ntitle or other qualifying documentation has been\n\ntransferred from the permittee.\n\n9. A permit issued for loads specific to turbine blades, used\n\nfor the purpose of wind generation, may exceed a length of one\n\nhundred ten (110) feet.\n\nB. 1. The Department of Transportation may issue an annual\n\nvehicle permit under this subsection to a specific motor carrier,\n\nfor the movement of oversize or overweight loads that cannot\n\nreasonably be dismantled. An annual vehicle permit issued under\n\nthis subsection may be transferred from one vehicle to another\n\nvehicle in the fleet of the permittee provided:\n\na. that no more than one vehicle is operating at a time,\n\nand\n\nb. the original certified permit is carried in the\n\nvehicle that is being operated under the terms of the\n\npermit.\n\n2. An annual vehicle permit issued under this subsection shall\n\nbe sent to the permittee via first-class, registered mail, or at the\n\nrequest and expense of the permittee via overnight delivery service.\n\nThe annual vehicle permit shall not be duplicated. The annual\n\nvehicle permit shall be replaced only if:\n\na. the permittee did not receive the original permit\n\nwithin seven (7) business days after the date of\n\nissuance,\n\nb. a request for replacement is submitted to the\n\nDepartment of Transportation within ten (10) business\n\ndays after the original date of issuance of the\n\npermit, and\n\nc. the request for replacement is accompanied by a\n\nnotarized statement signed by a principal or officer\n\nof the permittee acknowledging that the permittee\n\nunderstands the permit may not be duplicated and that\n\nif the original permit is located, the permittee shall\n\nreturn either the original or replacement permit to\nten (10) business\n\ndays after the original date of issuance of the\n\npermit, and\n\nc. the request for replacement is accompanied by a\n\nnotarized statement signed by a principal or officer\n\nof the permittee acknowledging that the permittee\n\nunderstands the permit may not be duplicated and that\n\nif the original permit is located, the permittee shall\n\nreturn either the original or replacement permit to\n\nthe Department of Transportation.\n\n3. A request for replacement of an annual vehicle permit issued\n\npursuant to the provisions of this subsection shall be denied if the\n\nDepartment of Transportation can verify that the permittee received\n\nthe original annual vehicle permit.\n\n4. Lost, misplaced, damaged, destroyed or otherwise unusable\n\nannual vehicle permits shall not be replaced. A new permit shall be\n\nrequired and shall be issued by the Department of Transportation.\n\nC. 1. The Department of Transportation may issue an annual\n\nfleet permit under this subsection to an electric utility, regulated\n\nby the Corporation Commission or a rural electric cooperative solely\n\nfor the movement of poles. An annual fleet permit issued under this\n\nsubsection may be used by any vehicle in the fleet of the permittee\n\nprovided that a certified copy of the permit is carried in each\n\nvehicle that is being operated under the terms of the permit.\n\n2. Oversize loads operating under an annual permit issued\n\npursuant to this subsection shall not exceed:\n\na. twelve (12) feet in width,\n\nb. fourteen (14) feet in height, or\n\nc. fifty-five (55) feet in length.\n\n3. The annual fee for an annual fleet permit issued pursuant to\n\nthis subsection shall be Four Thousand Dollars ($4,000.00) and shall\n\nbe nonrefundable.\n\n4. The annual fleet permit shall be issued for a one-calendar-\n\nyear period and shall commence upon the date specified on the\n\npermit.\n\n5. The annual fleet permit issued under this subsection shall\n\nbe sent to the permittee via first class, registered mail, or at the\n\nrequest and expense of the permittee via overnight delivery service.\n\nThe annual permit shall be replaced only if:\n\na. the permittee did not receive the original permit\n\nwithin seven (7) business days after the date of the\n\nissuance,\n\nb. a request for replacement is submitted to the\n\nDepartment of Transportation within ten (10) business\n\ndays after the original date of issuance of the\n\npermit, and\n\nc. the request for replacement is accompanied by a\n\nnotarized statement signed by an authorized person of\n\nthe permittee acknowledging that if the original\n\npermit is located, the permittee shall either return\n\nthe original or replacement permit to the Department\n\nof Transportation.\n\n6. A request for replacement of an annual permit issued under\n\nthe provisions of this subsection shall be denied if the Department\n\nof Transportation can verify the permittee received the original\n\nannual permit.\n\n7. Lost, misplaced, damaged, destroyed or otherwise unusable\n\nannual permits shall not be replaced. A new permit shall be\n\nrequired and shall be issued by the Department of Transportation.\n\n8. For the purposes of paragraph 5 of subsection C of Section\n\n14-103 of this title, the term \"emergency\" means any permitted\n\nmovement of poles pursuant to the provisions of this subsection that\n\nis not for new construction of electric distribution facilities.\n\nD. 1. The Department of Transportation shall issue an annual\n\nvehicle permit under this subsection to a transportation company or\n\nmanufacturer of portable buildings solely for the movement of\n\noversize portable buildings for a specific manufacturer of portable\n\nbuildings. An annual vehicle permit issued under this subsection\n\nmay not be transferred from one vehicle to another vehicle in the\n\nfleet. The name of the manufacturer shall be on the permit and on\n\nany portable building being moved. The original certified permit\n\nshall be carried in the vehicle that is being operated under the\noversize portable buildings for a specific manufacturer of portable\n\nbuildings. An annual vehicle permit issued under this subsection\n\nmay not be transferred from one vehicle to another vehicle in the\n\nfleet. The name of the manufacturer shall be on the permit and on\n\nany portable building being moved. The original certified permit\n\nshall be carried in the vehicle that is being operated under the\n\nterms of the permit.\n\n2. Oversize loads operating under an annual vehicle permit\n\nissued pursuant to this subsection shall not exceed:\n\na. twelve (12) feet in width at the wall with no more\n\nthan a three-inch-eave overhang, or\n\nb. fourteen (14) feet in height.\n\n3. The total gross weight of oversize loads operating under an\n\nannual vehicle permit issued pursuant to this subsection shall not\n\nexceed forty-five thousand (45,000) pounds.\n\n4. The tow vehicle shall be limited to two axles, and the\n\nvehicle identification number of the vehicle shall be on the permit.\n\n5. The fee for an annual vehicle permit issued pursuant to this\n\nsubsection shall be Five Hundred Dollars ($500.00) and shall be\n\nnonrefundable.\n\n6. An annual vehicle permit issued under this subsection shall\n\nbe sent to the permittee via first-class, registered mail, or at the\n\nrequest and expense of the permittee via overnight delivery service.\n\nThe annual vehicle permit shall not be duplicated. The annual\n\nvehicle permit shall be replaced only if:\n\na. the permittee did not receive the original permit\n\nwithin seven (7) business days after the date of\n\nissuance,\n\nb. a request for replacement is submitted to the\n\nDepartment of Transportation within ten (10) business\n\ndays after the original date of issuance of the\n\npermit, and\n\nc. the request for replacement is accompanied by a\n\nnotarized statement signed by a principal or officer\n\nof the permittee acknowledging that the permittee\n\nunderstands the permit may not be duplicated and that\n\nif the original permit is located, the permittee shall\n\nreturn either the original or replacement permit to\n\nthe Department of Transportation.\n\n7. A request for replacement of an annual vehicle permit issued\n\npursuant to the provisions of this subsection shall be denied if the\n\nDepartment of Transportation can verify that the permittee received\n\nthe original annual vehicle permit.\n\n8.
