Stat. tit. 47, § 47-14-111","heading":"Weighing vehicles - Compelling unloading - Certificates","body":"- Bills of sale - Proof of ownership - Impounding.\n\nA. Any officer of the Department of Public Safety, the\n\nCorporation Commission, any sheriff, or any salaried deputy sheriff\n\nis authorized to stop any vehicle upon any road or highway in order\n\nto weigh such vehicle by means of portable or stationary scales, or\n\ncause the same to be weighed by any official weigher, or upon any\n\nprivately owned scales and may require that such vehicles be driven\n\nto the nearest or most convenient available scales for the purpose\n\nof weighing. Any officer weighing a vehicle pursuant to this\n\nsection by means of portable scales shall allow the driver of the\n\nvehicle to move the vehicle to the most level weighing area\n\navailable within two (2) miles of the stop. In the event that any\n\naxle weight or the gross weight of any such vehicle be found to\n\nexceed the maximum weight authorized by law, or by permit issued\n\ntherefor, the officer may require, in the case of separable loads,\n\nthe driver, operator or owner thereof to unload at the site such\n\nportion of the load as may be necessary to decrease the weight of\n\nsuch vehicle to the maximum weight authorized by law. Provided,\n\nhowever, that if such load consists of livestock, perishable\n\nmerchandise, or merchandise that may be destroyed by the weather,\n\nthen the driver shall be permitted to proceed to the nearest\n\npractical unloading point in the direction of destination before\n\ndischarging such excess cargo. All material so unloaded shall be\n\ncared for by the owner or operator of such vehicle at the risk of\n\nsuch owner or operator.\n\nB. The operator of any truck or other vehicle transporting farm\n\nproducts for hire or other merchandise for hire shall have in his or\n\nher possession a certificate carrying the following information:\n\nname of the operator; driver license number; vehicle registration\n\nnumber; Corporation Commission permit number; and statement of owner\n\nauthorizing transportation of the products by above named operator.\n\nFor the purposes of this section \"certificate\" includes electronic\n\nmanifests and other similar documents that include all of the\n\ninformation required pursuant to this section.\n\nShould the vehicle be loaded with livestock, the certificate\n\nshall include the number of animals, and should the livestock be the\n\nproperty of more than one person, a certificate signed by each owner\n\ncarrying the above information including the number of animals owned\n\nby each owner shall be carried by the operator. Should the operator\n\nbe the owner of the merchandise or livestock, the merchandise or\n\nlivestock having just been purchased, the operator shall have in his\n\nor her possession a bill of sale for such merchandise or livestock.\n\nShould the operator be the owner of livestock or other farm products\n\nproduced by the operator, the operator shall be required to show\n\nsatisfactory identification and ownership of the vehicle. Any\n\nofficer as outlined in this chapter shall have the authority to stop\n\nany vehicle loaded with livestock, merchandise or other farm\n\nproducts and investigate as to the ownership of the merchandise,\n\nlivestock or other farm products. Should the operator of any\n\nvehicle be unable to establish to the satisfaction of the officer\n\nthe ownership of the merchandise, livestock or other products, or\n\nshall not have the certificate as specified in this section for the\n\ntransportation of such merchandise, livestock or other farm\n\nproducts, the merchandise, livestock or other farm products and the\n\nvehicle in which they are being transported shall be impounded by\n\nthe officer and any expense as to the care of any livestock shall be\n\nthe responsibility of the owner or operator of the vehicle, and any\n\nloss or damage of the merchandise, livestock or other farm products\n\nshall be the responsibility of the operator or owner, or both.\n\nThe provisions of this subsection shall not apply to a person\nvehicle in which they are being transported shall be impounded by\n\nthe officer and any expense as to the care of any livestock shall be\n\nthe responsibility of the owner or operator of the vehicle, and any\n\nloss or damage of the merchandise, livestock or other farm products\n\nshall be the responsibility of the operator or owner, or both.\n\nThe provisions of this subsection shall not apply to a person\n\nwho is transporting horses or livestock; provided, the person shall\n\nnot have been hired to transport the horses or livestock.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3cacea8fa124c1002c0dd5256cfe1f06867d00b35a1ae9131611a659e1f2ab6b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-14-110","next":"us-ok/okla.-stat.-tit.-47-47-14-113"},"notice":"GroundRules: Original legal text.
