Stat. tit. 47, § 47-14-116","heading":"Permit fees - Escrow account system - Applications -","body":"Emergencies - Provisional permits - Violations - Disposition and\n\nallocation of proceeds.\n\nA. The Executive Director of the Department of Transportation\n\nshall charge a minimum permit fee of Forty Dollars ($40.00) for any\n\npermit issued pursuant to the provisions of Section 14-101 et seq.\n\nof this title. In addition to the permit fee, the Executive\n\nDirector of the Department of Transportation shall charge a fee of\n\nTen Dollars ($10.00) for each thousand pounds in excess of the legal\n\nload limit. The Executive Director of the Department of\n\nTransportation shall establish any necessary rules for collecting\n\nthe fees.\n\nB. The Department of Transportation is authorized to establish\n\nan escrow account system for the payment of permit fees. Authorized\n\nmotor carriers meeting established credit requirements may\n\nparticipate in the escrow account system for permits purchased from\n\nall size and weight permit offices in this state. Carriers not\n\nchoosing to participate in the escrow account system shall be\n\nrequired to make payment of the required fee or fees upon purchase\n\nof each permit as required by law. All monies collected through the\n\nescrow account system shall be deposited to a special account of the\n\nDepartment of Transportation and placed in the custody of the State\n\nTreasurer. Proceeds from permits purchased using the escrow account\n\nsystem shall be distributed as provided for in subsection H of this\n\nsection. However, fees collected through such accounts for the\n\nelectronic transmission, transfer or delivery of permits, as\n\nprovided for in Section 14-118 of this title, shall be credited to\n\nthe Weigh Station Improvement Revolving Fund established pursuant to\n\nSection 1167 of this title.\n\nC. 1. Application for permits shall be made a reasonable time\n\nin advance of the expected time of movement of such vehicles. For\n\nemergencies affecting the health or safety of persons or a\n\ncommunity, permits may be issued for immediate movement.\n\n2. Size and weight permit offices in all districts where\n\napplicable shall issue permits to authorize carriers by telephone\n\nduring weekdays.\n\nD. No overweight permit shall be valid until all license taxes\n\ndue the State of Oklahoma have been paid.\n\nE. No permit violation shall be deemed to have occurred when an\n\noversize or overweight movement is made pursuant to a permit whose\n\nstated weight or size exceeds the actual load.\n\nF. Any permit issued for a truck or truck-tractor operating in\n\ncombination with a trailer or a semitrailer shall contain only the\n\nlicense plate number for the truck or truck-tractor if the permittee\n\nprovides to the Department of Transportation a list containing the\n\nlicense plate number, and such other information as the Department\n\nof Transportation may prescribe by rule, for each trailer or\n\nsemitrailer which may be used for movement with the permit. When\n\nthe permittee provides the list described in this subsection, the\n\nlicense plate number for any trailer or semitrailer to be moved with\n\nthe permit shall not be included on the permit; provided, a trailer\n\nor semitrailer which is not on the list shall not be authorized to\n\nbe used for movement with the permit. It shall be the\n\nresponsibility of the permittee to ensure the list provided to the\n\nDepartment of Transportation is maintained and updated with any\n\nfleet changes. The Department of Transportation shall adopt any\n\nrules deemed necessary to administer the provisions of this\n\nsubsection.\n\nG. The first deliverer of motor vehicles designated truck\n\ncarriers or well service carriers manufactured in Oklahoma shall not\n\nbe required to purchase an overweight permit when being delivered to\n\nthe first purchaser.\n\nH. Except as provided in Section 14-122 of this title, the\n\nfirst One Million Two Hundred Sixteen Thousand Dollars\n\n($1,216,000.00) of proceeds from both the permit fees and the\n\noverweight permit fees imposed pursuant to subsection A of this\niers or well service carriers manufactured in Oklahoma shall not\n\nbe required to purchase an overweight permit when being delivered to\n\nthe first purchaser.\n\nH. Except as provided in Section 14-122 of this title, the\n\nfirst One Million Two Hundred Sixteen Thousand Dollars\n\n($1,216,000.00) of proceeds from both the permit fees and the\n\noverweight permit fees imposed pursuant to subsection A of this\n\nsection collected monthly shall be apportioned by Service Oklahoma\n\nas provided in Section 1104 of this title. For the fiscal year\n\nbeginning July 1, 2022, and all subsequent years, the next Two\n\nMillion Five Hundred Thousand Dollars ($2,500,000.00) of proceeds\n\nfrom both the permit fees and the overweight permit fees imposed\n\npursuant to subsection A of this section collected monthly shall be\n\nremitted to the Department of Public Safety for the purpose of\n\nstaffing the port of entry weigh stations with Department of Public\n\nSafety port of entry officers whose powers and duties shall be\n\nspecified by the Department of Public Safety through the\n\npromulgation of rules. For the fiscal year beginning July 1, 2017,\n\nand all subsequent years, all proceeds collected from both the\n\npermit fees and the overweight permit fees imposed pursuant to\n\nsubsection A of this section in excess of Three Million Seven\n\nHundred Sixteen Thousand Dollars ($3,716,000.00) shall be deposited\n\nin the Weigh Station Improvement Revolving Fund as provided in\n\nSection 1167 of this title for the purpose set forth in that section\n\nand may be used for motor carrier permitting systems and motor\n\ncarrier safety and enforcement.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4eff90af14017533941d12d8e8321f33b994e91aa36602b8ebf19cd4605818a9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-14-114","next":"us-ok/okla.-stat.-tit.-47-47-14-116a"},"notice":"GroundRules: Original legal text.
