Any tool, implement, or instrumentality, including but not\n\nlimited to a motor vehicle or motor vehicle part, used or possessed\n\nin connection with any violation of Section 3 of this act may be\n\nseized by a member of a state or local law enforcement agency upon\n\nprocess issued by any court of competent jurisdiction.\n\nB. Seizure of property described in subsection A of this\n\nsection may be made by a member of a state or local law enforcement\n\nagency without process if:\n\n1. in accordance with any applicable law or regulation;\n\n2. the seizure is incident to inspection under an\n\nadministrative inspection warrant;\n\n3. the seizure is incident to search made under a search\n\nwarrant;\n\n4. the seizure is incident to a lawful arrest;\n\n5. the seizure is made pursuant to a valid consent to search;\n\n6. the property seized has been the subject of a prior judgment\n\nin favor of the state in a criminal proceeding, or in an injunction\n\nor forfeiture proceeding under Section 6 of this act; or\n\n7. there are reasonable grounds to believe that the property is\n\ndirectly or indirectly dangerous to health or safety.\n\nC.
