Stat. tit. 47, § 47-156.1","heading":"Use of state-owned or state-leased motor vehicles for","body":"private use - Penalty - Exceptions - Temporary authorization -\n\nEmployee status report.\n\nA. It shall be unlawful for any state official, officer or\n\nemployee, except any essential employees approved by the Governor\n\nand those officers or employees authorized in subsection B of this\n\nsection, to ride to or from the place of residence of the employee\n\nin a state-owned or state-leased automobile, truck or pickup, except\n\nin the performance of the official duty of the employee, or to use\n\nor permit the use of any such automobile, truck, ambulance or pickup\n\nfor other personal or private purposes. Any person convicted of\n\nviolating the provisions of this section shall be guilty of a\n\nmisdemeanor and shall be punished by a fine of not more than One\n\nHundred Dollars ($100.00) or by imprisonment in the county jail for\n\na period to not exceed thirty (30) days, or by both said fine and\n\nimprisonment, and in addition thereto, shall be discharged from\n\nstate employment.\n\nB. 1. Any state employee, other than the individuals provided\n\nfor in paragraph 2 of this subsection and any employee of the\n\nDepartment of Public Safety who is a wrecker inspector or auditor of\n\nthe Wrecker Services Division as provided for in paragraph 3 of this\n\nsubsection, who receives emergency telephone calls regularly at the\n\nresidence of the employee when the employee is not on duty and is\n\nregularly called upon to use a vehicle after normal work hours in\n\nresponse to such emergency calls, may be permitted to use a vehicle\n\nbelonging to the state to provide transportation between the\n\nresidence of the employee and the assigned place of employment,\n\nprovided such distance does not exceed seventy-five (75) miles in\n\nany round trip or is within the county where the assigned place of\n\nemployment is located. Provided further, an employee may be\n\npermitted to use a state-owned or state-leased vehicle to provide\n\ntemporary transportation between a specific work location other than\n\nthe assigned place of employment and the residence of the employee,\n\nif such use shall result in a monetary saving to the agency, and\n\nsuch authorization shall not be subject to the distance or area\n\nrestrictions provided for in this paragraph. Authorization for\n\ntemporary use of a state-owned or state-leased vehicle for a\n\nspecific project shall be in writing stating the justification for\n\nthis use and the saving expected to result. Such authorization\n\nshall be valid for not to exceed sixty (60) days. Any state entity\n\nother than law enforcement that avails itself of this provision\n\nshall keep a monthly record of all participating employees, the\n\nnumber of emergency calls received and the number of times that a\n\nstate vehicle was used in the performance of such emergency calls.\n\n2. Any employee of the Department of Public Safety, Oklahoma\n\nDepartment of Corrections, Office of the Attorney General, Oklahoma\n\nState Bureau of Narcotics and Dangerous Drugs Control, Oklahoma\n\nState Bureau of Investigation, Alcoholic Beverage Laws Enforcement\n\nCommission, Oklahoma Horse Racing Commission, Oklahoma Department of\n\nAgriculture, Food, and Forestry, Office of the Inspector General\n\nwithin the Department of Human Services or Office of the State Fire\n\nMarshal, who is a law enforcement officer or criminalist, Public\n\nInformation officer, Special Investigator or Assistant Director of\n\nthe Oklahoma State Bureau of Investigation, the Executive Director\n\nof CLEET, CLEET-certified Investigator for a state board or any\n\nemployee of a district attorney who is a law enforcement officer,\n\nmay be permitted to use a state-owned or state-leased vehicle to\n\nprovide transportation between the residence of the employee and the\n\nassigned place of employment and between the residence and any\n\nlocation other than the assigned place of employment to which the\n\nemployee travels in the performance of the official duty of the\n\nemployee.\nof a district attorney who is a law enforcement officer,\n\nmay be permitted to use a state-owned or state-leased vehicle to\n\nprovide transportation between the residence of the employee and the\n\nassigned place of employment and between the residence and any\n\nlocation other than the assigned place of employment to which the\n\nemployee travels in the performance of the official duty of the\n\nemployee.\n\n3. Any employee of the Department of Public Safety who is a\n\nwrecker inspector or auditor of the Wrecker Services Division, or a\n\nnoncommissioned pilot may be permitted, as determined by the\n\nCommissioner, to use a state-owned or state-leased vehicle to\n\nprovide transportation between the residence of the employee and the\n\nassigned place of employment and between the residence and any\n\nlocation other than the assigned place of employment to which the\n\nemployee travels in the performance of the official duty of the\n\nemployee.\n\n4. The Director, department heads and other essential employees\n\nof the Department of Wildlife Conservation, as authorized by the\n\nWildlife Conservation Commission, may be permitted to use a state-\n\nowned or state-leased vehicle to provide transportation between the\n\nresidence of the employee and the assigned place of employment and\n\nbetween the residence and any location other than the assigned place\n\nof employment to which the employee travels in the performance of\n\nthe official duty of the employee.\n\n5. The Director, department heads, emergency responders and\n\nother essential employees of the Department of Corrections, as\n\nauthorized by the Director, may be permitted to use a state-owned or\n\nstate-leased vehicle to provide transportation between the residence\n\nof the employee and the assigned place of employment and between the\n\nresidence and any location other than the assigned place of\n\nemployment to which the employee travels in the performance of the\n\nofficial duty of the employee.\n\n6. Designated Examiner Auditors, Designated Examiner\n\nSupervisors, Commercial Driver License Examiners, Commercial Driver\n\nLicense Auditors, Commercial Driver License Supervisors, and Driver\n\nLicense Supervisors, as an employee of Service Oklahoma may be\n\npermitted, as determined by the Director of Service Oklahoma, to use\n\na state-owned or state-leased vehicle to provide transportation\n\nbetween the residence of the employee and the assigned place of\n\nemployment and between the residence and any location other than the\n\nassigned place.\n\n7. The Attorney General, division heads, emergency responders,\n\nagents, assistant attorneys general, and other essential employees\n\nof the Office of the Attorney General, as authorized by the Attorney\n\nGeneral, may be permitted to use a state-owned or state-leased\n\nvehicle to provide transportation between the residence of the\n\nemployee and the assigned place of employment and between the\n\nresidence and any location other than the assigned place of\n\nemployment to which the employee travels in the performance of the\n\nofficial duty of the employee.\n\nC. The principal administrator of the state agency with which\n\nthe employee is employed shall so designate the status of the\n\nemployee in writing or provide a copy of the temporary authorization\n\nto the Governor, the President Pro Tempore of the Senate and the\n\nSpeaker of the House of Representatives.
