This act shall be known and may be cited as the “Household\n\nGoods Act of 2009”. The purpose of this act is to regulate\n\nintrastate transportation by motor carriers of household goods in\n\nsuch manner as to establish standards for public safety, fair\n\ncompetitive practices, adequate and dependable service, and\n\nprotection of shippers from deceptive or unfair practices.\n\nB. The provisions of this act, except as specifically limited\n\nherein, shall apply to the intrastate transportation of household\n\ngoods by motor carriers over public highways of this state; and the\n\nregulations of such transportation, and the procurement thereof and\n\nthe provisions of facilities therefor, are hereby vested in the\n\nCorporation Commission.\n\nShipments contracted by the federal government, a state\n\ngovernment, a tribal government or any local government or political\n\nsubdivision thereof shall not be required to obtain a household\n\ngoods certificate, but shall be regulated by the Commission to\n\nachieve compliance with safety requirements and size and weight\n\nlimitations.\n\nNothing in this act shall be construed to interfere with the\n\nexercise by agencies of the government of the United States of its\n\npower of regulation of interstate commerce.\n\nC. As used in this act:\n\n1. \"Commission\" means the Corporation Commission;\n\n2. \"Corporate family\" means a group of corporations consisting\n\nof a parent corporation and all subsidiaries in which the parent\n\ncorporation owns directly or indirectly one hundred percent (100%)\n\ninterest;\n\n3. \"Household goods\" means used personal effects and property\n\nof a dwelling;\n\n4. \"Household goods certificate\" means a certificate of\n\nauthority issued by the Corporation Commission to transport\n\nhousehold goods within this state;\n\n5. \"Intercorporate hauling\" means the transportation of\n\nhousehold goods, by motor vehicle, for compensation, by a carrier\n\nwhich is a member of a corporate family, as defined in this section,\n\nwhen the transportation for compensation is provided for other\n\nmembers of the corporate family;\n\n6. \"Motor carrier of household goods\" means a person\n\ntransporting household goods for compensation or other\n\nconsideration, with an origin and destination within this state;\n\n7. \"Motor vehicle\" means any automobile, truck, truck-tractor,\n\ntrailer or semitrailer or any motor bus or self-propelled vehicle\n\nnot operated or driven upon fixed rails or tracks;\n\n8. \"Person\" means any individual, firm, copartnership, limited\n\npartnership, corporation, limited liability corporation, company,\n\nassociation, or joint-stock association and includes any trustee,\n\nreceiver, assignee, or personal representative thereof; and\n\n9. \"Public highway\" means every public street, road, highway,\n\nor thoroughfare in this state, used by the public, whether actually\n\ndedicated to the public and accepted by the proper authorities or\n\notherwise.\n\nD.
