The Corporation Commission is authorized to:\n\n1. Supervise and regulate every motor carrier of household\n\ngoods;\n\n2. Protect the shipping and general public by requiring\n\nliability insurance and cargo insurance of all motor carriers of\n\nhousehold goods;\n\n3. Ensure motor carriers of household goods are complying with\n\napplicable size and weight laws and safety requirements;\n\n4. Supervise and regulate such motor carriers in all other\n\nmatters affecting the relationship between such carriers and the\n\ntraveling and shipping public including, but not limited to,\n\nconsumer protection measures and loss and damage claim procedures;\n\nand\n\n5. Enforce the provisions of this act.\n\nB. The Commission is authorized to promulgate rules applicable\n\nto persons transporting household goods.\n\nC. 1. The Commission is authorized to administer a hazardous\n\nmaterial transportation registration and permitting program for\n\nmotor carriers engaged in transporting hazardous material upon or\n\nover the public highways and within the borders of the state.\n\n2. The Commission shall promulgate rules implementing the\n\nprovisions of this subsection. Rules promulgated pursuant to this\n\nsubsection shall be consistent with, and equivalent in scope,\n\ncoverage, and content to requirements applicable to operators of\n\nvehicles transporting hazardous materials contained in the report\n\nsubmitted to the Secretary of the United States Department of\n\nTransportation, pursuant to 49 U.S.C. 5119(b), by the Alliance for\n\nUniform Hazardous Material Transportation Procedures.\n\nD. Nothing in this section shall be construed to remove or\n\naffect the jurisdiction of the Department of Environmental Quality\n\nto implement hazardous waste transportation requirements for federal\n\nhazardous waste program delegation to this state under the federal\n\nResource Conservation and Recovery Act.\n\nE.
