Stat. tit. 47, § 47-170.1","heading":"Complaints - Notice and hearing - Orders - Revocation -","body":"Liability of complaining party - Appeal.\n\nA. Upon any complaint in writing under oath being made by any\n\nperson, or by the Commission of its own motion, setting forth any\n\nact or thing done or omitted to be done by any person in violation,\n\nor claimed violation, of any provision of law, or of any order or\n\nrule of the Commission, the Commission shall enter same upon its\n\ndocket and shall immediately serve a copy thereof upon each\n\ndefendant together with a notice directed to each defendant\n\nrequiring that the matter complained of be answered, in writing,\n\nwithin ten (10) days of the date of service of such notice, provided\n\nthat the Commission may, in its discretion, require particular cases\n\nto be answered within a shorter time, and the Commission may, for\n\ngood cause shown, extend the time in which an answer may be filed.\n\nUpon the filing of the answer herein provided for, the\n\nCommission shall set a time and place for the hearing, and notice of\n\nthe time and place of the hearing shall be served not less than ten\n\n(10) days before the time set therefor, unless the Commission shall\n\nfind that public necessity requires the hearing at an earlier date.\n\nB. The Commission may, in all matters within its jurisdiction,\n\nissue subpoenas, subpoenas duces tecum, and all necessary process in\n\nproceedings pending before the Commission; may administer oaths,\n\nexamine witnesses, compel the production of records, books, papers,\n\nfiles, documents, contracts, correspondence, agreements, or accounts\n\nnecessary for any investigation being conducted, and certify\n\nofficial acts.\n\nC. In case of failure on the part of any person to comply with\n\nany lawful order of the Commission, or of any Commissioner, or with\n\nany subpoena or subpoena duces tecum, or to testify concerning any\n\nmatter on which he may be lawfully interrogated, the Commission may\n\ncompel obedience by proceedings for contempt as in the case of\n\ndisobedience of the requirements of a subpoena, or of the refusal to\n\ntestify.\n\nD. Witnesses who are summoned before the Commission shall be\n\npaid the same fees and mileage as are paid to witnesses in courts of\n\nrecord. Any party to a proceeding at whose instance a subpoena is\n\nissued and served shall pay the costs incident thereto and the fees\n\nfor mileage of all his witnesses.\n\nE. In event any process shall be directed to any nonresident\n\nwho is authorized to do business in this state, the process may be\n\nserved upon the agent designated by the nonresident for the service\n\nof process, and service upon the agent shall be as sufficient and as\n\neffective as if served upon the nonresident.\n\nF. All process issued by the Commission shall extend to all\n\nparts of the state and any such process, together with the service\n\nof all notices issued by the Commission, as well as copies of\n\ncomplaints, rules, orders and regulations of the Commission, may be\n\nserved by any person authorized to serve process issued out of\n\ncourts of record, or by certified mail.\n\nG. After the conclusion of any hearing, the Commission shall,\n\nwithin sixty (60) days, make and file its findings and order, with\n\nits opinion. Its findings shall be in sufficient detail to enable\n\nany court in which any action of the Commission is involved to\n\ndetermine the controverted questions presented by the proceeding. A\n\ncopy of such order, certified under the seal of the Commission,\n\nshall be served upon the person against whom it runs, or the\n\nattorney of the person, and notice thereof shall be given to the\n\nother parties to the proceedings or their attorneys. The order\n\nshall take effect and become operative within fifteen (15) days\n\nafter the service thereof, unless otherwise provided. If an order\n\ncannot, in the judgment of the Commission, be complied with within\n\nfifteen (15) days, the Commission may grant and prescribe such\n\nadditional time as in its judgment is reasonably necessary to comply\nhe\n\nother parties to the proceedings or their attorneys. The order\n\nshall take effect and become operative within fifteen (15) days\n\nafter the service thereof, unless otherwise provided. If an order\n\ncannot, in the judgment of the Commission, be complied with within\n\nfifteen (15) days, the Commission may grant and prescribe such\n\nadditional time as in its judgment is reasonably necessary to comply\n\nwith the order, and may, on application and for good cause shown,\n\nextend the time for compliance fixed in the order.\n\nH. In the event the Commission finds that the defendant is\n\nguilty upon any complaint filed and proceeding had and that the\n\nprovisions of law, or the rules, regulations or orders of this\n\nCommission have been willfully and knowingly violated and the\n\nviolator holds a permit or certificate or license issued by the\n\nCommission authorizing it to engage in the transportation of persons\n\nor property for hire, then such permit or certificate or license may\n\nalso be revoked by the Commission.\n\nI. Where a complaint is instituted by any person other than the\n\nCommission of its own motion and in the event the Commission should\n\nfind that the complaint was not in good faith, the complaining party\n\nshall be required to pay the defendant's attorney's fee, the fee to\n\nbe prescribed by the Commission in accordance with applicable\n\nOklahoma Bar Association standards.\n\nJ.
