Stat. tit. 47, § 47-170.2","heading":"Report of load capacity violations to Corporation","body":"Commission - Contempt of Commission motor carrier rules, tariffs and\n\nregulations - Penalties - Complaint procedure.\n\nA. The Department of Public Safety, monthly, shall notify the\n\nOklahoma Corporation Commission of any ticket issued for a violation\n\nof the provisions of Section 14-119 of this title, or any provisions\n\nof Chapter 14 of this title or the terms of any special permit\n\nauthorized pursuant to the provisions of Chapter 14 of this title\n\nconcerning overweight or overweight special permits.\n\nB. Truck overweight violations by motor carriers or private\n\ncarriers shall be considered contempt of Commission motor carrier\n\nrules, tariffs and regulations. The Commission shall establish a\n\nspecific rule whereby such overweight violations by motor carriers\n\nor private carriers shall be grounds for issuance of a show-cause\n\norder for consideration of temporary or permanent cancellation of\n\noperating authority or license. In establishing the rule,\n\nconsideration shall be given to the frequency of violations, pattern\n\nof violations, fleet size, type of operation, amount of overweight,\n\nand other such factors that may indicate intent. Any person, firm,\n\nor corporation that assists in the commission of such overweight\n\nviolation or refuses to comply with any rule, regulation, or order\n\nof the Commission relating thereto shall be guilty of contempt of\n\nthe Commission and shall be subject to a fine to be imposed by said\n\nCommission in a sum not to exceed Five Hundred Dollars ($500.00) on\n\neach violation. In the specific instance of an overweight\n\nviolation, the transportation of each load shall constitute a\n\nseparate violation. The same fine assessed against the motor\n\ncarrier or private carrier shall apply to any other person, firm, or\n\ncorporation that aids or abets such violations. Provided however,\n\nno motor carrier, private carrier, shipper or person loading or\n\ncausing a motor vehicle to be loaded shall be subject to a fine for\n\ncontempt unless the gross weight of the motor vehicle is more than\n\nfive thousand (5,000) pounds overweight.\n\nC. The Commission, in its discretion and on its own motion, may\n\nmake a contempt complaint in writing under oath setting forth the\n\nviolation, enter the complaint on its docket, and proceed with the\n\nmatter in accordance with the provisions of Sections 161 et seq. of\n\nthis title or the Motor Carrier Act of 1995.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"27ef2794f3d565f859ce9ea6bb44b9d1fa15f563a5e0527904730e5ae60996dd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-170.1","next":"us-ok/okla.-stat.-tit.-47-47-1700"},"notice":"GroundRules: Original legal text.
