It shall be unlawful for a motor carrier, whether private,\n\ncommon, or contract, to dump, disperse, or otherwise release\n\nsubstances described in Section 177.2 of this title upon a public\n\nhighway or elsewhere except on property or in wells, reservoirs, or\n\nother receptacles owned, held, leased, or otherwise rightfully and\n\nlegally available to the motor carrier for such use and purpose.\n\nB. It shall be unlawful for any motor truck or tank vehicle\n\nused to transport substances described in Section 177.2 of this\n\ntitle to have a release device located or operated in any manner\n\nfrom within the cab of such a motor vehicle.\n\nC. Any violation of the provisions of subsections A or B of\n\nthis section shall constitute a misdemeanor. It shall be the duty\n\nof the prosecuting attorney of the county in which a violation of\n\nthe provisions of this section occurs to file and prosecute the\n\naforementioned misdemeanor charge and advise the Commission of such\n\naction and the results thereof.\n\nD. The Oklahoma Corporation Commission may initiate contempt\n\nproceedings for any violation concerning disposal by a carrier of a\n\nsubstance described in Section 177.2 of this title. The first\n\nviolation proven by the Commission in any calendar year shall result\n\nin a motor carrier or private carrier being warned by the Commission\n\nand, upon conviction, fined up to Two Thousand Five Hundred Dollars\n\n($2,500.00). A second violation proven by the Commission in any\n\ncalendar year shall result in a motor carrier or private carrier\n\nbeing placed on probation and fined up to Five Thousand Dollars\n\n($5,000.00) by the Commission. A third violation proven by the\n\nCommission in any calendar year shall result in a fine of up to\n\nTwenty Thousand Dollars ($20,000.00), and, at the discretion of the\n\nCommission, cancellation of the carrier's license for a period up to\n\none (1) year and cancellation of a motor carrier or private carrier\n\ndeleterious substance transport permit. The driver of a truck, who\n\nis not the owner of the vehicle used in violation of this section or\n\nany of the rules and regulations of the Oklahoma Corporation\n\nCommission, shall be adjudicated a codefendant and subject to a fine\n\nequal to ten percent (10%) of the fine assessed to the owner of such\n\nvehicle, up to Five Hundred Dollars ($500.00).","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d88f53c1be57e2d1e7db78bb8fd4db4b6f9f023d86ae6ffbb3bc90d93a4ec1f4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-177.2","next":"us-ok/okla.-stat.-tit.-47-47-18-101"},"notice":"GroundRules: Original legal text.
