The Commissioner, subject to the Merit System laws, if\n\napplicable, shall appoint a Chief of Administration and such other\n\ndeputies, subordinates, officers, investigators and other employees\n\nas may be necessary to implement the provisions of this title. Any\n\nemployee of the Department of Public Safety appointed to the\n\nposition of Chief of Administration who is otherwise statutorily\n\neligible shall have a right to return to the previous position of\n\nthe employee without any loss of rights, privileges or benefits\n\nimmediately upon completion of the duties as Chief of\n\nAdministration, provided the employee is not otherwise disqualified.\n\nB. When traveling with the Governor or at his or her request:\n\n1. Those personnel assigned by the Commissioner for executive\n\nsecurity shall be allowed their actual and necessary traveling\n\nexpenses, upon claims approved by the Commissioner, and shall\n\nreceive, in addition to base salary, an additional One Hundred\n\nSeventy-five Dollars ($175.00) per month; and\n\n2. Those personnel serving as noncommissioned pilots in the\n\nDepartment of Public Safety shall be allowed their actual and\n\nnecessary traveling expenses, upon claims approved by the\n\nCommissioner.\n\nC. Any person appointed to the position of Chief of\n\nAdministration of the Department of Public Safety shall be eligible\n\nfor retirement participation as a member of the Highway Patrol\n\nDivision in the Oklahoma Law Enforcement Retirement System if such\n\nperson at the time of appointment satisfies the age qualifications\n\nof an Oklahoma Highway Patrolman as provided in subsection B of\n\nSection 2-105 of this title, and is otherwise eligible to\n\nparticipate in the retirement program; otherwise, the Chief of\n\nAdministration shall participate in the Oklahoma Public Employees\n\nRetirement upon appointment. However, the Chief of Administration\n\nshall be eligible for participation in only one retirement system\n\nand shall elect in writing the system in which the Chief of\n\nAdministration intends to participate.\n\nD.
