Stat. tit. 47, § 47-2-106.2A","heading":"Transfer of powers and duties","body":"All the powers, duties, functions, records, employees, property,\n\nmatters pending and funds of the Department of Highways, the Highway\n\nSafety Coordinating Committee and the Railroad Maintenance Authority\n\nare hereby transferred to the Department of Transportation.\n\nEffective July 1, 1993, all powers, duties, functions, records,\n\nemployees, matters pending and funds of the Department of\n\nTransportation that were transferred to the Department because of\n\nthe abolishment of the Highway Safety Coordinating Committee shall\n\nbe transferred to the Department of Public Safety, pursuant to\n\nSection 3 of this act. Except as specifically directed by the\n\nLegislature the State Department of Transportation shall not fund,\n\ndirectly or indirectly, any railroad, mass transit, public\n\ntransportation, marine, waterways or aeronautics construction,\n\noperations or maintenance with dedicated gasoline taxes,\n\nappropriated highway construction or maintenance funds or other\n\nhighway funds; provided, however, that nothing herein contained\n\nshall be construed to prevent the Department of Transportation from\n\napplying for, accepting, receiving, administering or expending\n\nmonies appropriated for the specific purpose of matching federal\n\ngrants now or hereafter made available for transportation planning\n\nor improvements in nonhighway transportation modes. The Department\n\nof Transportation shall not issue bonds which constitute an\n\nobligation or debt of the state or a pledge of the faith and credit\n\nof the state, except as specifically authorized by the Legislature.\n\nAny change of agency name/names on signs, equipment, vehicles or\n\nother property shall be accomplished as said signs, equipment,\n\nvehicles or other property are replaced in inventory or as required\n\nthrough normal wear and tear.
