Stat. tit. 47, § 47-2-307.2","heading":"Service credit for unused sick leave - Prorated","body":"service credit for sick or temporary disability time - Option to\n\npurchase service credit.\n\nA. The total service credit of a member who retires, elects a\n\nDeferred Option Plan or terminates employment and elects a vested\n\nbenefit shall include not to exceed one hundred thirty (130) days of\n\nunused sick leave accumulated while a member of the System.\n\nEffective July 1, 2008, a member who retires, elects a Deferred\n\nOption Plan or terminates employment and elects a vested benefit\n\nshall include not to exceed two hundred forty (240) days of unused\n\nsick leave accumulated while a member of the System. Such credit\n\nshall be added in terms of whole months. Twenty (20) days of unused\n\nsick leave shall equal one (1) month for purposes of service credit.\n\nIf unused sick leave entitles a member to an additional year or\n\nfraction thereof of service credit, the member's employer shall\n\nreimburse the System for the cost of funding the additional reserve\n\nby paying the amount determined by the Board pursuant to Section 25\n\nof this act. Each employer shall provide the System with adequate\n\nand timely information necessary to determine additional benefits\n\nand its cost under this section. This section shall apply to\n\nmembers retiring or vesting on or after July 1, 1985, and shall not\n\nbe retroactive. The amount of accrued sick leave available for\n\ndetermination of a member's monthly benefit for purposes of the\n\ndeferred option election shall be limited to the accrued sick leave\n\navailable as of the effective date of the deferred option election,\n\nbut not to exceed two hundred forty (240) days. The member's\n\nmonthly benefit determined as of the effective date of the deferred\n\noption election shall not be adjusted for additional accrued sick\n\nleave earned by the member after the deferred option election.\n\nB. Whenever any member is unable to perform the member's duties\n\nbecause of sickness or temporary disability caused or sustained\n\nwhile in the discharge of the member's duty as a member, is\n\nreceiving a temporary total disability benefit under Section 1 et\n\nseq. of Title 85A of the Oklahoma Statutes, and does not purchase\n\nservice credit as described below, such member shall only receive\n\nprorated service credit based on the contributions made by the\n\nmember and the member's employer while the member is receiving a\n\ntemporary total disability benefit under Section 1 et seq. of Title\n\n85A of the Oklahoma Statutes. Whenever any member is unable to\n\nperform the member's duties because of sickness or temporary\n\ndisability caused or sustained while in the discharge of the\n\nmember's duty as a member and is receiving a temporary disability\n\nbenefit under Section 1 et seq. of Title 85A of the Oklahoma\n\nStatutes, such member shall have the option to purchase service\n\ncredit for the time related to such leave of absence for such\n\nsickness or temporary disability.\n\n1. The payment for such purchase must be completed no later\n\nthan three (3) years from the date the member commenced receipt of a\n\ntemporary total disability benefit.\n\n2. The purchase price shall be:\n\na. the actual paid base salary that the member was\n\nentitled to immediately prior to the member's sickness\n\nor temporary disability minus any vacation or sick\n\nleave payments received by the member during such\n\nsickness or temporary disability, multiplied by,\n\nb. the following, as applicable:\n\n(1) the combined employer and member contribution\n\npercentages, pursuant to Section 2-304 of this\n\ntitle, for members who are suspended without pay,\n\nor\nness\n\nor temporary disability minus any vacation or sick\n\nleave payments received by the member during such\n\nsickness or temporary disability, multiplied by,\n\nb. the following, as applicable:\n\n(1) the combined employer and member contribution\n\npercentages, pursuant to Section 2-304 of this\n\ntitle, for members who are suspended without pay,\n\nor\n\n(2) the member contribution percentage, pursuant to\n\nSection 2-304 of this title, for members who are\n\nnot suspended without pay.\n\nIf such member has not been suspended without pay, the employer\n\nshall contribute, within three (3) months of the completion of the\n\nmember's purchase of service credit, the employer contribution\n\npercentage, pursuant to Section 2-304 of this title, times the\n\nactual paid base salary that the member was entitled to immediately\n\nprior to the member's sickness or temporary disability minus any\n\nvacation or sick leave payments received by the member during such\n\nsickness or temporary disability.\n\n3. The member may purchase such service credit through:\n\na. a cash lump-sum payment,\n\nb. a trustee-to-trustee transfer of non-Roth funds from a\n\nCode Section 403(b) annuity or custodial account, an\n\neligible deferred compensation plan described in Code\n\nSection 457(b) which is maintained by an eligible\n\nemployer described in Code Section 457(e)(1)(A),\n\nand/or a Code Section 401(a) qualified plan,\n\nc. a direct rollover of tax-deferred funds from a Code\n\nSection 403(b) annuity or custodial account, an\n\neligible deferred compensation plan described in Code\n\nSection 457(b) which is maintained by an eligible\n\nemployer described in Code Section 457(e)(1)(A), a\n\nCode Section 401(a) qualified plan, and/or a Code\n\nSection 408(a) or 408(b) traditional or conduit\n\nIndividual Retirement Account or Annuity (IRA).
