A member who terminates his service before normal retirement\n\ndate, other than by death or disability, shall, upon application\n\nfiled with the Board, be entitled to be refunded from the fund an\n\namount equal to the accumulated contributions the member has made to\n\nthe fund, but excluding any interest or any amount contributed by\n\nthe state. If such member has completed ten (10) years of credited\n\nservice at the date of termination, the member may elect a vested\n\nbenefit in lieu of receiving his accumulated contributions.\n\nIf the member who has completed ten (10) or more years of\n\ncredited service elects the vested benefit, the member shall be\n\nentitled to a monthly retirement annuity commencing on the member's\n\nnormal retirement date to be determined as if the member's\n\nemployment continued uninterrupted. The annual amount of such\n\nretirement annuity shall be equal to two and one-half percent (2\n\n1/2%) of final average salary multiplied by the number of years of\n\ncredited service. The death benefits provided for under Section 2-\n\n306 of this title shall apply to any member retiring under the\n\nprovisions of this subsection.\n\nB. A member who terminated service before the normal retirement\n\ndate of such member and elected a vested benefit in lieu of\n\nreceiving accumulated contributions may upon reemployment be allowed\n\nfull credit toward retirement for all credited service accrued for\n\nthe vested benefit. This subsection shall apply to employees of the\n\nOklahoma State Bureau of Investigation, the Oklahoma State Bureau of\n\nNarcotics and Dangerous Drugs Control, the Department of Public\n\nSafety and the Oklahoma Alcoholic Beverage Control Board whose\n\nbenefits had vested in the Oklahoma Public Employees Retirement\n\nSystem prior to the establishment of the Oklahoma Law Enforcement\n\nRetirement System. Upon reemployment of said employee by an agency\n\nwhose employees are now members of the Oklahoma Law Enforcement\n\nRetirement System, the Oklahoma Public Employees Retirement System\n\nshall transfer to the Oklahoma Law Enforcement Retirement System all\n\nfunds contributed by the individual member being reemployed and all\n\nfunds contributed by the state for such member.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f17debe1ad2e87d3045cedd5df3296dac06a3352ca1fa208a867ad1881ab02c7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-2-307.7","next":"us-ok/okla.-stat.-tit.-47-47-2-308.1"},"notice":"GroundRules: Original legal text.
