Stat. tit. 47, § 47-2-309.6","heading":"Capitol patrol members and park managers and","body":"supervisors - Transfer to Oklahoma Law Enforcement Retirement System\n\nfrom Oklahoma Public Employees Retirement System.\n\nA. For purposes of this section, \"capitol patrol members\" means\n\nlaw enforcement officers of the State Capitol Division of the\n\nDepartment of Public Safety employed on July 1, 1993, who, pursuant\n\nto the provisions of this act, transfer membership from the Oklahoma\n\nPublic Employees Retirement System to the Oklahoma Law Enforcement\n\nRetirement System.\n\nB. Capitol patrol members are hereby transferred from the\n\nOklahoma Public Employees Retirement System to the Oklahoma Law\n\nEnforcement Retirement System subject to the following:\n\n1. Effective July 1, 1993, capitol patrol members who are\n\nmembers of the Oklahoma Public Employees Retirement System shall\n\ncease accruing benefits in the Oklahoma Public Employees Retirement\n\nSystem and shall commence accruing benefits in the Oklahoma Law\n\nEnforcement Retirement System;\n\n2. Before January 1, 1994, the Oklahoma Public Employees\n\nRetirement System shall transfer to the Oklahoma Law Enforcement\n\nRetirement System the actual amount contributed to the Oklahoma\n\nPublic Employees Retirement System from time to time by the capitol\n\npatrol members while members of the Oklahoma Public Employees\n\nRetirement System and the contributions by the participating\n\nemployer or employers on behalf of each capitol patrol member to the\n\nOklahoma Law Enforcement Retirement System along with the retirement\n\nrecords of said transferring capitol patrol members;\n\n3. Service credit accrued by a capitol patrol member while a\n\nmember of the Oklahoma Public Employees Retirement System shall be\n\ntreated as credited service for such transferring capitol patrol\n\nmember in the Oklahoma Law Enforcement Retirement System if the\n\ncapitol patrol member is not receiving or eligible to receive\n\nservice credit or benefits from said service in any other public\n\nretirement system and the member has not received service credit for\n\nthe same years of service pursuant to Sections 2-307.1, 2-307.3 and\n\n2-307.4 of Title 47 of the Oklahoma Statutes. Provided, however,\n\nthat the total of credited service for each transferring employee\n\nshall not exceed the credited service said employee could have\n\naccrued if his or her entire employment with an agency of the State\n\nof Oklahoma had been as an employee of the Department of Public\n\nSafety. Provided further, that only transferred credited service\n\nrelated to actual law enforcement service with the State Capitol\n\nPatrol Division of the Department of Public Safety will be included\n\nin the determination of a capitol patrol member's normal retirement\n\ndate or vesting date; and\n\n4. All service credit with the Oklahoma Public Employees\n\nRetirement System which is ineligible for transfer to the Law\n\nEnforcement Retirement System shall be canceled.\n\nC. Any park manager or park supervisor of the Oklahoma Tourism\n\nand Recreation Department who was employed in such a position prior\n\nto July 1, 1985, and who elects on or before September 1, 1996, to\n\nparticipate in the Oklahoma Law Enforcement Retirement System is\n\nhereby transferred from the Oklahoma Public Employees Retirement\n\nSystem to the Oklahoma Law Enforcement Retirement System subject to\n\nthe following:\n\n1. Effective July 1, 1996, park managers and park supervisors\n\nwho are members of the Oklahoma Public Employees Retirement System\n\nand who elect on or before September 1, 1996, to participate in the\n\nOklahoma Law Enforcement Retirement System shall cease accruing\n\nbenefits in the Oklahoma Public Employees Retirement System and\n\nshall commence accruing benefits in the Oklahoma Law Enforcement\n\nRetirement System;\n\n2. Before January 1, 1997, the Oklahoma Public Employees\n\nRetirement System shall transfer to the Oklahoma Law Enforcement\n\nRetirement System the actual amount contributed to the Oklahoma\n\nPublic Employees Retirement System by the park manager or park\nnefits in the Oklahoma Public Employees Retirement System and\n\nshall commence accruing benefits in the Oklahoma Law Enforcement\n\nRetirement System;\n\n2. Before January 1, 1997, the Oklahoma Public Employees\n\nRetirement System shall transfer to the Oklahoma Law Enforcement\n\nRetirement System the actual amount contributed to the Oklahoma\n\nPublic Employees Retirement System by the park manager or park\n\nsupervisor while he or she was a member of the Oklahoma Public\n\nEmployees Retirement System and the contributions by the\n\nparticipating employer or employers on behalf of each park manager\n\nor park supervisor who elects to become a member of the Oklahoma Law\n\nEnforcement Retirement System along with the retirement records of\n\nsaid transferring park manager or park supervisor;\n\n3. To receive service credit accrued by such park manager or\n\npark supervisor prior to July 1, 1996, or prior to the date as of\n\nwhich the person making the election ceases to be a member of the\n\nOklahoma Public Employees Retirement System, whichever date occurs\n\nlast, the member shall pay the difference between the amount\n\ntransferred by the Oklahoma Public Employees Retirement System to\n\nthe Oklahoma Law Enforcement Retirement System in paragraph 2 of\n\nthis subsection and the amount determined by the Board of Trustees\n\npursuant to Section 2-307.5 of this title. The park manager or park\n\nsupervisor shall elect to either pay any difference to receive full\n\ncredit for the years sought to be transferred or receive prorated\n\nservice credit for only the amount received from the Oklahoma Public\n\nEmployees Retirement System pursuant to this subsection. Such an\n\nelection shall be made in writing, filed with the System prior to\n\nreceiving the credit provided for in paragraph 10 of Section 2-300\n\nof this title, and shall be irrevocable. Payments made by park\n\nmanagers or park supervisors pursuant to this paragraph shall be\n\nmade on or before January 1, 1997;\n\n4. Service credit accrued by a park manager or park supervisor\n\nwhile a member of the Oklahoma Public Employees Retirement System\n\nshall be treated as credited service for such transferring park\n\nmanagers or park supervisors in the Oklahoma Law Enforcement\n\nRetirement System if the park manager or park supervisor is not\n\nreceiving or eligible to receive service credit or benefits from\n\nsaid service in any other public retirement system and the member\n\nhas not received service credit for the same years of service\n\npursuant to Sections 2-307.1, 2-307.3 and 2-307.4 of this title.\n\nProvided, however, that the total of credited service for each\n\ntransferring employee shall not exceed the credited service the\n\nemployee could have accrued if his or her entire employment with an\n\nagency of the State of Oklahoma had been as an employee of the\n\nOklahoma Tourism and Recreation Department. Provided further, that\n\nonly transferred credited service related to park ranger, park\n\nmanager or park supervisor service with the Oklahoma Tourism and\n\nRecreation Department will be included in the determination of a\n\npark manager or park supervisor's normal retirement date or vesting\n\ndate; and\n\n5.
