Stat. tit. 47, § 47-2-310.2","heading":"Law Enforcement Retirement System members - Inability","body":"to perform duties - Administrative leave with pay - Transfer of\n\ntemporary disability benefits.\n\nWhenever any member of the Oklahoma Law Enforcement Retirement\n\nSystem currently working in a position identified by paragraph 6 of\n\nSection 2-300 of this title who is enrolled in the Oklahoma Law\n\nEnforcement Retirement System is unable to perform the member’s\n\nduties because of sickness or temporary disability caused or\n\nsustained while in the discharge of the member’s duty as such\n\nmember, notwithstanding the provisions of Section 840-2.21 of Title\n\n74 of the Oklahoma Statutes or the provisions of Title 85A of the\n\nOklahoma Statutes, the member may be placed on administrative leave\n\nwith pay by the employing agency for a period of ninety (90) days\n\nwith the employing agency having the option of extending the leave\n\nperiod for up to an additional ninety (90) days, not to exceed a\n\ntotal of one hundred eighty (180) days. The member’s salary and\n\nbenefits shall continue to be paid by the employing agency without\n\nany decrease or disruption of the salary and benefits. If the\n\nrecovery period is longer than one hundred eighty (180) days, the\n\nmember shall use sick leave, annual leave or other authorized leave.\n\nShould a member receiving a salary under this section be eligible to\n\nreceive and should the salary of the member under this section\n\nexceed any temporary disability benefit paid to the member under\n\nSection 1 et seq. of Title 85A of the Oklahoma Statutes, the member\n\nshall transfer such temporary disability benefits under Section 1 et\n\nseq. of Title 85A of the Oklahoma Statutes to the employing agency\n\nwhile the member is sick or temporarily disabled.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"da149c863c289e6b99addf0817ca5e1b7ca5f0999442cbfa548558050c4b2c68","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-2-310.1","next":"us-ok/okla.-stat.-tit.-47-47-2-312"},"notice":"GroundRules: Original legal text.
