Members of the Oklahoma Public Employees Retirement System\n\nwho are active Lake Patrolmen or Dispatchers of the Grand River Dam\n\nAuthority on June 30, 2003, may make an irrevocable written election\n\non or before January 1, 2004, to participate in the Oklahoma Law\n\nEnforcement Retirement System. Such patrolmen and dispatchers who\n\nmake the election as provided by this section shall be subject to\n\nthe following:\n\n1. Upon the date the patrolman or dispatcher makes the election\n\npursuant to this section, he or she shall cease accruing benefits in\n\nthe Oklahoma Public Employees Retirement System and shall commence\n\naccruing benefits in the Oklahoma Law Enforcement Retirement System;\n\n2. Prior to the beginning of the month following receipt of the\n\npatrolman’s or dispatcher’s election by the Oklahoma Public\n\nEmployees Retirement System, the Oklahoma Public Employees\n\nRetirement System shall transfer to the Oklahoma Law Enforcement\n\nRetirement System all employee contributions and employer\n\ncontributions including any amounts received by the Oklahoma Public\n\nEmployees Retirement System on behalf of a transferring member\n\nrelated to a purchase or transfer of credited service to the\n\nOklahoma Public Employees Retirement System. The Oklahoma Public\n\nEmployees Retirement System shall also send to the Oklahoma Law\n\nEnforcement Retirement System the retirement records of the\n\ntransferring member;\n\n3. To receive service credit accrued by such transferring\n\nmember prior to the election, or prior to the date as of which the\n\nperson making the election ceases to be a member of the Oklahoma\n\nPublic Employees Retirement System, whichever date occurs last, the\n\nmember shall make an irrevocable written election. The election\n\nshall be to either pay the difference between the amount transferred\n\nby the Oklahoma Public Employees Retirement System to the Oklahoma\n\nLaw Enforcement Retirement System in paragraph 2 of this subsection\n\nand the amount determined by the Board of Trustees pursuant to\n\nSection 2-307.5 of Title 47 of the Oklahoma Statutes to receive full\n\neligible credit for the years sought to be transferred or receive\n\neligible prorated service credit for only the amount received from\n\nthe Oklahoma Public Employees Retirement System pursuant to this\n\nsubsection. Payments made by such transferring members pursuant to\n\nthis paragraph shall be made pursuant to subsection B of Section 2-\n\n307.5 of Title 47 of the Oklahoma Statutes;\n\n4. Service credit shall only be transferable pursuant to this\n\nsection if the transferring member is not receiving or eligible to\n\nreceive service credit or benefits from said service in any other\n\npublic retirement system and has not received service credit for the\n\nsame years of service pursuant to Sections 2-307.1, 2-307.3 and 2-\n\n307.4 of Title 47 of the Oklahoma Statutes. Provided further, that\n\nonly transferred credited service related to Lake Patrol service as\n\na patrolman or dispatcher with the Grand River Dam Authority and any\n\nother law enforcement related service, including service with the\n\nDepartment of Corrections as a correctional officer or probation and\n\nparole officer or any credited service that was purchased or\n\ntransferred to the Oklahoma Public Employees Retirement System from\n\nthe Oklahoma Law Enforcement Retirement System or the Oklahoma\n\nPolice Pension and Retirement System, shall be included in the\n\ndetermination of an officer’s normal retirement date or vesting date\n\nin the Oklahoma Law Enforcement Retirement System; and\n\n5. All service credit with the Oklahoma Public Employees\n\nRetirement System which is ineligible for transfer to the Oklahoma\n\nLaw Enforcement Retirement System shall be canceled.\n\nB. The Grand River Dam Authority shall be a participating\n\nemployer in the Oklahoma Law Enforcement Retirement System for all\n\nGrand River Dam Lake Patrolmen and Dispatchers who participate in\nent Retirement System; and\n\n5. All service credit with the Oklahoma Public Employees\n\nRetirement System which is ineligible for transfer to the Oklahoma\n\nLaw Enforcement Retirement System shall be canceled.\n\nB.
