No person who provides assistance or advice in mitigating or\n\nattempting to mitigate the effects of an actual or threatened\n\ndischarge of hazardous material, or in preventing, cleaning up, or\n\ndisposing or in attempting to prevent, clean up or dispose of any\n\nsuch discharge, shall be subject to any civil liability or\n\nadministrative penalties as a result of such assistance or advice.\n\nB. The immunities provided in subsection A of this section\n\nshall not apply:\n\n1. To any person whose act or omission caused in whole or in\n\npart such actual or threatened discharge and who would otherwise be\n\nliable therefor;\n\n2. To any person who receives compensation, other than\n\nreimbursement for out-of-pocket expenses, for services in rendering\n\nsuch assistance or advice; or\n\n3. To a common carrier relative to its handling or transporting\n\nof hazardous materials.\n\nC.
