Any person driving under a commercial Class A license shall\n\nnot be required to obtain a hazardous materials endorsement pursuant\n\nto 49 C.F.R. Section 383 if the person is:\n\n1. Acting within the scope of the license holder's employment\n\nas an employee of a custom harvester operation, agrichemical\n\nbusiness, farm retail outlet and supplier or livestock feeder;\n\n2. Is operating a service vehicle that is transporting diesel\n\nin a quantity of three thousand seven hundred eighty-five (3,785)\n\nliters or one thousand (1,000) gallons or less; and\n\n3.
